<br />e <br /> <br />. <br /> <br />ORDINANCE NO. 1126 <br /> <br />- <br /> <br />AN ORDINANCE AMENDING CHAPTER I,P, ARTICLE I OF THE CODE OF <br />ORDINANCES OF THE CITY OF LA PORTE, PROVIDING THAT IT SHALL <br />BE A NUISANCE TO POSSESS, TRANSPORT, OR DETONATE FIREWORKS <br />WITHIN THE CITY LIMITS AND WITHIN A DISTANCE OF FIVE THOUSAND <br />FEET (5000') OUTSIDE OF THE CITY; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF <br />A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM <br />NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 10-2(a) Code of Ordinances, City of <br /> <br />La Porte, Texas is hereby amended to read as follows: <br /> <br />- <br /> <br />II (a) Except as otherwise specifically provided in this <br />section, it shall be a nuisance and it shall be unlawful <br />for any person to manufacture, assemble, store, transport, <br />rec.eive, keep, sell, offer, or have in his possession <br />with intent to sell, use, discharge, cause to be discharged, <br />ignite, detonate, fire or otherwise set in action any <br />fireworks of any description, within the city limits <br />and within a distance of Five Thousand Feet (5000') outside <br />the city and not within any other city.1I <br /> <br />Section 2. Any person as defined in Texas Penal Code Section <br /> <br />1.07 (27) who shall violate any provision of this Ordinance, shall <br /> <br />be deemed guilty of a misdemeanor and upon conviction shall be <br /> <br />punished by a fine not to exceed Two Hundred Dollars ($200.00). <br /> <br />Each day any violation of this Ordinance shall continue shall <br /> <br />constitute a separate offense. <br /> <br />Section 3. This Ordinance shall be effective fourteen (14) <br /> <br />days after its passage and approval. The City Clerk shall give <br /> <br />notice of the passage of this ordinance by causing the caption <br />~ hereof to be published in the official newspaper in the City of <br />La Porte at least twice within ten (10) days after the passage of <br /> <br />this ordinance. <br /> <br />Section 4. If any section, sentence, phrase, clause, or any <br /> <br />part of any section, sentence, phrase, or clause, of this ordinance <br /> <br />shall, for any reason, be held invalid, such invalidity shall not <br /> <br />affect the remaining portions of this Ordinance, and it is hereby <br /> <br />declared to be the intention of this City Commission to have <br /> <br />passed each section, sentence, phrase, clause, or part thereof, <br /> <br />irrespective of the fact that any other section, sentence, phrase <br /> <br />. <br />
