<br />. . <br /> <br />ORDINANCE NO. 1112 <br /> <br />e. <br /> <br />AN ORDINANCE AMENDING CHAPTER 21, SECTIONS 25 AND 28, OF THE <br />CODE OF ORDINANCES OF THE CITY OF LA PORTE, PROVIDING THAT ALL <br />CHURCHES AS DEFINED IN THE ORDINANCE SHALL BE EXEMPT FROM <br />PAYMENT OF APPLICATION FEE AND APPRAISED AMOUNT FOR VACATING, <br />ABANDONING AND CLOSING STREETS AND ALLEYS; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />,...... <br />,. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 21-25, "Application fee" under Chapter <br /> <br />21 STREETS AND SIDEWALKS, Article III "Vacating, Abandoning and <br /> <br />Closing Streets and Alleys," of the Code of Ordinances of the <br /> <br />City of La Porte, is hereby amended to include subsection (c) <br /> <br />as follows, to-wit: <br /> <br />"(c) Any corporation or association organized and <br /> <br />operated exclusively for religious purposes, no part of the <br /> <br />net earnings of which inure to the benefit of any private <br /> <br />- <br /> <br />shareholder or individual, shall be exempted from the payment <br /> <br />of an application fee under this section." <br /> <br />Section 2. Section 21-28, "Final determination by <br /> <br />commission; appraisal; conveyance" under Chapter 21 STREETS <br /> <br />AND SIDEWALKS, Article III "Vacating, Abandoning and Closing <br /> <br />Streets and Alleys," of the Code of Ordinances of the City of <br /> <br />La Porte, is hereby amended and shall hereafter read as <br /> <br />follows, to-wit: <br /> <br />"Sec. 21-28. Final determination by commission; appraisal; <br />conveyance. <br /> <br />. <br /> <br />Upon compliance with all provisions of this article, <br />the city commission shall make a final determination as <br />to whether or not an application filed under this article <br />shall be granted or denied. Streets or alleys, whether <br />owned by the city in fee or used by easement, may be sold <br />to the abutting owner or owners in proportion to their <br />abutting ownership, such division between owners to be <br />made in an equitable manner. In addition, any land or <br />interest therein which was originally acquired for the <br />purpose of streets, rights-of-way or easements which the <br />city chooses to trade or exchange as consideration for <br />other land acquired for streets, rights-of-way or ease- <br />ments, including transactions which may be partly for <br />cash and partly by trade or exchange. Nothing in this <br />article shall require the city commission to accept any <br />bid or offer or be required to consummate any sale or <br />trade. Any conveyance, sale or trade made under this <br />article shall never be for less than the fair market <br />value of the land or interest being conveyed, sold or <br />traded, as determined by an appraisal obtained by the <br />city commission at applicant's expense, which shall be <br />conclusive of the market value thereof; all as provided <br />in Art. 542lc-12, Revised Civil Statutes. Provided, <br />however, that any corporation or association organized <br />and operated exclusively for religious purposes, no part <br />of the net earnings of which inure to the benefit of any <br />private individual or shareholder, shall be exempted <br />from the provisions of this section." <br /> <br />. <br />
