<br />e <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />1070 <br /> <br />AN ORDINANCE DESCRIBING THE FUNCTIONS, DUTIES AND POWERS OF <br />SHELTER MANAGERS DURING NATIONAL EMERGENCIES; AUTHORIZING <br />SHELTER MANAGERS TO USE REASONABLE RESTRAINT AGAINST THOSE <br />WHO REFUSE TO COOPERATE WITH THE ROUTINE OF SHELTER LIVING <br />UNDER Ef4ERGENCY CONDITIONS; PROVIDING THAT ANY PERSON VIO- <br />LATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY <br />OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY <br />SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING <br />AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY CO~~ISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. In case of national emergency, Public Shelter <br /> <br />Managers duly appointed by the Civil Preparedness Director, <br /> <br />shall open public shelters, take charge of all stocks of food, <br /> <br />. <br /> <br />water, and other supplies stored in said shelter, admit the <br /> <br />public according to the City's shelter use plan and take what- <br /> <br />ever control measures are necessary for the protection and <br /> <br />safety of the occupants. <br /> <br />Section 2. Shelter Managers are authorized to use reason- <br /> <br />able restraint against those who refuse to cooperate with the <br /> <br />routine of shelter living under emergency conditions. Refusal <br /> <br />to carry out the orders of the Shelter Manager, or his appointed <br /> <br />staff, shall be deemed in violation hereof. <br /> <br />Section 3. Any person, as defined in Section 1.07(27), <br /> <br />. <br /> <br />Texas Penal Code, who shall violate any provision of this <br /> <br />ordinance, shall be deemed guilty of a misdemeanor and upon <br /> <br />conviction shall be punished by a fine not to exceed Two <br /> <br />Hundred Dollars ($200.00). <br /> <br />Section 4. This Ordinance shall be effective fourteen <br /> <br />(14) days after its passage and approval. The City Clerk <br /> <br />shall give notice of the passage of this ordinance by causing <br /> <br />the caption hereof to be published in the official newspaper <br /> <br />in the City of La Porte at least twice within ten (10) days <br /> <br />after the passage of this ordinance. <br /> <br />. <br />
