<br />ORDINANCE NO. 154l <br /> <br />AN ORDINANCE VACATING, ABANDONING, AND CLOSING THAT PORTION OF <br />A SIXTEEN FOOT (16') RIGHT-OF-WAY LOCATED BETWEEN LOTS ONE (1) <br />THROUGH SIXTEEN (16) AND LOTS SEVENTEEN (17) THROUGH THIRTY-TWO <br />(32), BLOCK ONE THOUSAND ONE HUNDRED SIX (1106), TOWN OF <br />LA PORTE, HARRIS COUNTY, TEXAS: FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW: AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City Council of the City of La Porte has <br /> <br />been requested by the record owners of all of the property <br /> <br />abutting the dedicated road as shown on Exhibit "A", attached <br /> <br />hereto and fully incorporated by reference herein: and <br /> <br />WHEREAS, the owner of said property requesting the closing <br /> <br />"of the right-of-way herein described has given the City of La <br /> <br />Porte his release, forever holding the City of La Porte harmless <br /> <br />from any actions that might occur as a result of the abandonment <br /> <br />by the City of La Porte of a four inch (4") water line within <br /> <br />said right-of-way: and <br /> <br />WHEREAS, the City Council of the City of La Porte has <br /> <br />determined, and does hereby find, determine, and declare that <br /> <br />the hereinafter described right-of-way lying between Lots One (l) <br />through Sixteen (16) and Lots Seventeen (17) through Thirty-Two <br />(32), Block One Thousand One Hundred Six (1106), Town of La Porte, <br /> <br />Harris County, Texas, is not suitable, needed, or beneficial to <br /> <br />the public as a public road or street, and that the closing of <br /> <br />.. the hereinafter.. described portion said right of.. way is, for the <br /> <br />protection of the public and for ,the public interest and benefit, <br />and that the hereinafter described portion of said right-of-way <br /> <br />should be vacated, abandoned, and permanently closed: <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LA PORTE: <br /> <br />Section 1. Under and by virtue of the power granted to the <br /> <br />city of La Porte under its Home Rule Charter and Chap. 13, Title <br />28, Art. l175, of the Revised Civil Statutes of the State of <br /> <br />Texas, 1925, the hereinafter described right-of-way lying wholly <br /> <br />within the boundary of the City of La Porte and being located <br /> <br />......... <br /> <br />, ....-------:::::,.. <br /> <br />/' <br />
