<br />WEEREAS, the city has requested the State of Texas to conbribute financial-
<br />:~r in the' street project j and
<br />
<br />WBEREAS, the State of Texas has made +b known to the city that it will
<br />al3sist the city in the street project by furniGhing the necessary f'unds f.or a.ctual
<br />construction, reconstruction a.o.d mainte:c..o.nco; and by supervisil:\g construction, pro-
<br />v:Lding the city approves the plans, grades and alignment for said projectj and
<br />
<br />'~S, the city~ in consideration of the providing of said project,
<br />agrees to indemnify the State of Texas against all damages or claims for da.mage to
<br />~1~1n1ng, abutting or other prpperty for which the State is liable, ariSing out
<br />of, i:J.cident to, and in any way connected with the installation, thE!....:.... construc-
<br />tton, the existence, the use and. maintenance of the street project or the passage
<br />a::'ld enforcement of this ordinance.,

<br />NOW THEREFORE,' BE ;}:T ORDAINED BY TEE' CIrrr COUNCIL:

<br />S~CTION 1. That since the public convenience, safety aQd necessity of the
<br />city an?- the people of the city require it, aald street shall be.........., constrvC"ted.

<br />SECTICN 2. That the State of Te~s be and is hereby authorized to enter

<br />shown on the plans, attached hereto and market "Exhibit A" and made a part hereof

<br />the State ,of Texas to pay any direct, incilental, or consequental damages to
<br />adjoining, abutting -or other property in enforcement of this ordinance or by
<br />reason of the installation, ........... construction, existence, use and maintenance of
<br />the street project authorized herein.
