ORDINANCE NO.20254057 <br />AN ORDINANCE REPEALING ORDINANCE 2024-3972, CONCERNING CONDEMNATION OF <br />THE RESIDENTIAL BUILDING LOCATED ON LOTS 20 & 21 BLOCK 197 LA PORTE, HARRIS <br />COUNTY, TEXAS, MORE COMMONLY KNOWN AS 114 S. IOWA ST.; AND RPEALING <br />ORDINANCE 2024-3972 CONTAINING A SERVERABILITY CLAUSE; CONTAINING A <br />REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPENS MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE THEREOF. <br />WHEREAS, the City Council of the City of La Porte passed and approved Ordinance 2024-3972 <br />on June 24, 2024, for the purpose of condemning and ordering the removal of the residential building situated <br />on real property commonly known as 114 S. Iowa St., La Porte, Texas; and <br />WHEREAS, subsequent to passage of Ordinance 2024-3972 by the La Porte City Council, Waimea <br />Investments LLC, the owner of real property and the residential building situated thereon, located at the <br />said 114 S. Iowa St., made contact with the City and requested additional time to repair the building; and <br />NOW THEREFORE: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br />SecQgpl, Ordinance 2024-3972 passed by the La Porte City Council on June 24, 2024, is hereby <br />repealed in its entirety. <br />Section L2. Should any section or part of this ordinance be held unconstitutional, illegal, or invalid, <br />or the application to any person or circumstance for any reasons thereof ineffective or inapplicable, such <br />unconstitutionality, illegality, invalidity, or ineffectiveness of such section or part shall in no way affect, <br />impair or invalidate the remaining portions thereof; but as to such remaining portion or portions, the same <br />shall be and remain in full force and effect and to this end the provisions of this ordinance are declared to <br />be severable. <br />Section 1, The City Council officially finds, determines, recites and declares that a sufficient <br />written notice of the date, hour, place and subject of this meeting of the City Council is posted at a place <br />convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as <br />required by Chapter 551, TX. Gov't Code; and that this meeting has been open to the public w required by <br />law at all times during which this ordinance and the subject matter thereof has been discussed, considered and <br />formally acted upon. The City Council further ratifies, approves and confirms such written notice and the <br />contents and posting thereof. <br />Section 4. This Ordinance shall take effect and be in force beginning on May 27, 2025, at I L00 <br />p.m. CST, subject to the condition that an authorized agent of Waimea Investments LLC, the owner of the <br />real property at 114 S. Iowa St., is issued a building permit by the City of La Porte for construction work <br />associated with the residential building located at 114 S. Iowa St., no later than 5:00 p.m. CST on May 27, <br />2025. Should Waimea Investments LLC and/or its authorized agent fail to receive a building permit for <br />construction work associated with the residential building located at 114 S. Iowa St. by 5:00 p.m. CST on <br />May 27, 2025, then in that event this Ordinance shall not take effect and shall be null and void. <br />
