-- . RESOLUTION NO. 73-,01 ;. WHEREAS, the City Commission of the Cityof La Porte has found that public necessity requires the location, construction, operation and maintenance of water and sewer lines across the hereinafter described portion of Block Three Hundred Five (305), TOWN OF LA PORTE, Harris County, Texas; and WHEREAS, the City Commission of the City of La Porte has found and determined that an easement in and to the hereinafter described property is suitable for such purpose and that it is necessary to acquire same for such water and sewer facilities, as aforesaid: -. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: That the City Attorney of the City of La Porte be, and he is hereby, a.uthorized to negotiate with .the owners of such hereinafter described land, concerning the acquisition by the City of La Port,e of the water and sewer easement, at the fair market value for same, and, should the City Attorney, as the duly authorized representative of the City of La Porte, be unable to agree with such owners as to the fair market value of such easements, then, and in that event, the City Attorney of the City of La Porte be and he is hereby authorized and directed to file against all owners and lienholders, proceedings -. in eminent domain to acquire an easement as hereinafter described for water and sanitary sewer purposes in and to the following described tract of land, to-wit: BEING a utility easement 16 feet in width, over and across parts of Lots 18, 19, 20, 21, 22, and 23, Block 305, Town of La Porte, Harris County, Texas, according to the map or plat thereof recorded in the office of the County Clerk of Harris County, Texas, and being a Southerly extension of the dedicated alley that is adjacent to the West line of Lots 30 through 38, both inclusive, Block 305, TOWN OF LA PORTE, Harris County, Texas. ~ ~.' -'.... ~ . <PASSED AND APPROVED, this 5th day of February, 1973.
