<br />.,.~ <br /> <br />e: <br /> <br />e.---. <br /> <br />.--~ <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />875 <br /> <br />AN ORDINANCE DEFINING "MODEL GLUE;" PROHIBITING THE <br />INHALATION OF "MODEL GLUE;" PROHIBIT.J:NG SALE OR TRANSFER OF <br />"MODEL GLUE" FOR UNLAWFUL PURPOSES; REGULATING THE USE OF <br />"MODEL GLUE" BY MINORS; REQUIRING A RECORD OF SALES OF <br />"MODEL GLUE" TO MINORS; PROVIDING THAT ANY PERSON VIOLATING <br />THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND <br />UPON CONVICTION SHALL BE FINED IN AN AMOUNT NOT TO EXCEED <br />TWO HUNDRED DOLLARS ($200.00), AND THAT EACH DAY OF ANY SUCH <br />VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; AND PROVIDING <br />AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section I. Model glue--Definition. <br /> <br />As used in this Ordinance the te:r:m "model glue" shall mean <br /> <br />any glue or cement of the type commonly used in the building of <br /> <br />model airplanes, boats, and automobiles, containing toluene, <br /> <br />acetone, or other solvent or chemical having the property of <br /> <br />releasing toxic vapors. <br /> <br />Section 2. Same--Inhalation of fumes prohibited. <br /> <br />No person shall, for the purpose of causing a condition <br /> <br />of intoxication, euphoria, excitement, exhilaration, stupe- <br /> <br />faction, or dulling of the senses or nervous system, intention- <br /> <br />ally smell or inhale the fumes from any model glue; provided, <br /> <br />however, that this section shall not apply to the inhalation <br /> <br />of any medicine for medical or dental purposes, if such <br /> <br />inhalation is caused by or administered by any licensed doctor, <br /> <br />physician, dentist, anesthesiologist, or other licensed person <br /> <br />engaging in the medical or dental profession. <br /> <br />Section 3. Same--Possession or transfer for unlawful <br />purposes prohibited. <br /> <br />No person shall for the purpose of violating or aiding <br />another to violate any provision of this Ordinance, intention- <br /> <br />ally possess, buy, sell, transfer possession, or receive <br /> <br />possession of any model glue. <br />Section 4. Same--Use by minors regulated. <br /> <br />(a) Except as provided in subsections (c) and (d) hereof <br /> <br />and Section 5, no person under twenty-one (21) years of age <br /> <br />shall possess or buy any model glue. <br />
