The tenn does not, hOATever, include either <br />(1) any project for :i.nprovement of a structure to carply with existing State or <br />local health, sanitary, or safety code specifications Which are solely necessaxy <br />to assure safe living conditions, or (2) any alterations of a structure listed on <br />the National Register of Historic Places or a State Inventory of Historic Places. <br /> <br />Variance-is a grant of relief to a person fran the requirements of this Ordinance <br />When specific enforcement \\Ould result in unnecessary hardship. A variance, <br />therefore, pennits construction or developnent in a manner otheJ:Wi.se prchibited by <br />this Ordinance. <br /> <br />ARl'ICLE 3. GENERAL PROVISIONS <br /> <br />SECI'ION A. IANDS 'ro WHICH THIS ORDINANCE APPLms <br /> <br />This Ordinance shall apply to all areas of SPeCial flood hazard within the juris- <br />diction of the City of La Porte. <br /> <br />SECI'ION B. BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FIDOD HAZARD <br /> <br />The areas of special flood hazards identified by the Federal Emergency Management <br />Agency in a scientific and engineering report entitled liThe Flood Insurance <br />Study for the City of La Porte, Texas, II dated November, 1984, with accarrpanying <br />Flood Insurance Rate Maps and Flood Boundary-Floodway Maps and any revisions <br />thereto are hereby adopted by reference and declared to be a part of this Ordinance. <br /> <br />SECl'ION C. ESTABLISHMENl' OF DEVEWPMENl' PERMIT <br /> <br />A Developnent Pennit shall be required to ensure conforrrance with the provisions <br />of this Ordinance. <br /> <br />SECI'ION D. COMPLIANCE <br /> <br />No structure or land shall hereafter be located, altered, or have its use changed <br />without full conpliance with the term; of this Ordinance and other applicable <br />regulations. <br /> <br />SECI'ION E. ABROGATION AND GRFATER RESTRIcrIONS <br /> <br />This Ordinance is not intended to rePeal, abrogate, or inpair any existing ease- <br />ments, covenants, or deed restrictions.
