INTERPRETATION In the interpretation and application of this Ordinance, all provisions shall be: (a) considered as minimum requirements: (b) liberally construed in favor of the governing body: and (c) deemed neither to limit nor repeal any other parrers granted under State statutes. SECl'ICN G. WARNING AND DISCIAIMER OF LIABILITY The degree of flood protection required by this Ordinance is considered reason- able for regulatory purposes and is based on scientific and engineering considera- tions. On rare occasions greater floods can and will occur and flood heights may be increased by man-made or natural causes. This Ordinance does not inply that land outside the areas of special flood hazards or uses pennitted within suCh areas will be free fran flooding or flood damages. This Ordinance shall not create liability on the part of the City of La Porte or any officer or enployee thereof for any flood damages that result fran reliance on this Ordinance or any adminis- trative decision lawfully made thereunder. ARI'ICLE 4. AD1INISTRATICN S~ION A. DESIGNATION OF FLOOD PLAIN ADMINISTRATOR The Director of Carmmity Develo,pnent for the City of La Porte, Texas, or his designated representative is hereby appointed as Flood Plain Administrator to administer and iIcplement the provisions of this Ordinance. S~ION B. DUTIES AND RESPONSIBILITIES OF THE FLOOD PLAIN ADMINISTRATOR Duties and responsibilities of the Flood Plain Administrator shall include, but not be limited to, the folla.ring: (l) Maintain and hold open for public inspection all records pertaining to the provisions of this ordinance: (2) Review, approve or deny all applications for developnent pennits, required by adoption of this Ordinance: (3) Review pennits for proposed developnent to assure that all necessary pennits have been obtain fran those Federal, State or local govern- mental agencies (including Section 404 of the Federal Water Pollution Control Act Amendments of 1972, 33 U.S.C. 1334) from which prior approval is required. (4) Where interpretation is needed as to the exact location of the boundaries of the areas of special flood hazard (for exanple, Where there apPears to be a conflict between ma];Ped boundary and actual field conditions) the Flood Plain Administrator shall rrake the necessary interpretation. (5) Notify adjacent corrmmi.ties as well as the Harris County Flood Control District and the Texas Water Camnission prior to any alteration or relocation of a watercourse, and sul::mit evidence of such notification to the Federal Errergency Management Agency. (6) Assure that maintenance is provided within the altered or relocated portion of said watercourse so that the flood carrying capacity is
