INTERPRETATION <br /> <br />In the interpretation and application of this Ordinance, all provisions shall be: <br /> <br />(a) considered as minimum requirements: <br />(b) liberally construed in favor of the governing body: and <br />(c) deemed neither to limit nor repeal any other parrers granted under <br />State statutes. <br /> <br />SECl'ICN G. WARNING AND DISCIAIMER OF LIABILITY <br /> <br />The degree of flood protection required by this Ordinance is considered reason- <br />able for regulatory purposes and is based on scientific and engineering considera- <br />tions. On rare occasions greater floods can and will occur and flood heights may <br />be increased by man-made or natural causes. This Ordinance does not inply that <br />land outside the areas of special flood hazards or uses pennitted within suCh <br />areas will be free fran flooding or flood damages. This Ordinance shall not create <br />liability on the part of the City of La Porte or any officer or enployee thereof <br />for any flood damages that result fran reliance on this Ordinance or any adminis- <br />trative decision lawfully made thereunder. <br /> <br />ARI'ICLE 4. AD1INISTRATICN <br /> <br />S~ION A. DESIGNATION OF FLOOD PLAIN ADMINISTRATOR <br /> <br />The Director of Carmmity Develo,pnent for the City of La Porte, Texas, or his <br />designated representative is hereby appointed as Flood Plain Administrator to <br />administer and iIcplement the provisions of this Ordinance. <br /> <br />S~ION B. DUTIES AND RESPONSIBILITIES OF THE FLOOD PLAIN ADMINISTRATOR <br /> <br />Duties and responsibilities of the Flood Plain Administrator shall include, but <br />not be limited to, the folla.ring: <br /> <br />(l) Maintain and hold open for public inspection all records pertaining <br />to the provisions of this ordinance: <br /> <br />(2) Review, approve or deny all applications for developnent pennits, <br />required by adoption of this Ordinance: <br /> <br />(3) Review pennits for proposed developnent to assure that all necessary <br />pennits have been obtain fran those Federal, State or local govern- <br />mental agencies (including Section 404 of the Federal Water Pollution <br />Control Act Amendments of 1972, 33 U.S.C. 1334) from which prior approval <br />is required. <br /> <br />(4) Where interpretation is needed as to the exact location of the boundaries <br />of the areas of special flood hazard (for exanple, Where there apPears <br />to be a conflict between ma];Ped boundary and actual field conditions) <br />the Flood Plain Administrator shall rrake the necessary interpretation. <br /> <br />(5) Notify adjacent corrmmi.ties as well as the Harris County Flood Control <br />District and the Texas Water Camnission prior to any alteration or <br />relocation of a watercourse, and sul::mit evidence of such notification <br />to the Federal Errergency Management Agency. <br /> <br />(6) Assure that maintenance is provided within the altered or relocated <br />portion of said watercourse so that the flood carrying capacity is <br />
