For these purposes, <br />staff sees no problem with including wrought iron fences within <br />the definition. However, inclusion of "acceptable steel mesh <br />fences" within the definition would seem to permit ambiguity <br />and an inconsistent standard for enforcement which would allow <br />discretion for acceptable fences to be placed on City staff. <br /> <br />ANALYSIS: Amend the definition to include wrought iron fences, <br />but leave out "acceptable steel mesh fences II. It should be <br />noted that staff sees no impact based upon the goals set forth <br />in the comprehensive Plan. <br /> <br />3) Height: <br /> <br />Citizen comment indicated that the definition should include a <br />permissible height of forty-five (45) feet from grade. Since <br />heights are already regulated within the body of the Ordinance, <br />in Section 5-700 Table B (Residential), Section 6-500 Table B <br />(Commercial},and Section 7-600 Table B (Industrial) inclusion of <br />regulatory material in the definition section of the Ordinance <br />would be inappropriate. <br /> <br />ANALYSIS: Leave tllis section of the Ordinance unchanged. <br /> <br />4) Ranch Trailer: <br /> <br />Citizen comment indicated that a definition of ranch trailer <br />was not included in the proposed Ordinance. Inclusion of a <br />definition of ranch trailer would allow ranch trailers to be <br />parked as an accessory use in residential zones. Allowing <br />ranch trailers to be parked in residential zones is important, <br />particularly in the Lomax area, and should be permitted under <br />the current ordinance. Allowing ranch trailers to be parked in <br />the Lomax area would be in furtherance of the Comprehensive <br />Plan objective of allowing continuance of large lot rural <br />residential uses in the Lomax area. Therefore, the definition <br />should be included, and should be consistent with the definition <br />currently utilized in the City's truck route ordinance. <br /> <br />ANALYSIS: Include the definition consistent with the City's <br />truck route ordinance. <br /> <br />5) Loading Berth: <br /> <br />Citizen comment indicates that there is a need in the Ordinance <br />for a definition of loading berth. Again, inclusion of this <br />definition neither furthers nor detracts from the goal of the <br />Comprehensive Plan, and it is deemed by staff that inclusion of <br />a definition aids in the clarity and consistency of the Ordinance <br />from an enforcement standpoint. <br />
