Further citizen comment indicates it <br />is not applicable to large tracts under single ownership which <br />have several zoning districts within the property boundary <br />line. It appears that this section as written would have <br />clear and effective application on small (less than lOO feet' <br />in width) tracts of land. However, large tracts might present <br />a problem in that large areas of land might be effectively <br />rezoned based upon the application of this ordinance section, <br />and contrary to the intent of the Planners, the City Planning <br />Commission, and City Council. As opposed to changing the use <br />of certain property due to inclusion of that property within <br />different district boundary lines, City staff would recommend <br />that the current decision rule as applied in Ordinance 780- <br />Section 9105 continue to be applied. The Current Ordinance <br />section indicates that in the case of a district boundary line <br />dividing a property into two parts, the district boundary <br />lines shall be construed to be the property line nearest the <br />district boundary line as shown. By maintaining this decision <br />rule, the in-tent of the Comprehensive Plan is not frustrated <br />and a boundary line determination system is maintained that <br />the staff, the Commission, and local developers are comfortable <br />wi th . <br /> <br />ANALYSIS: <br />to language <br />780. <br /> <br />Change Section <br />contained in <br /> <br />2-703 <br />Section <br /> <br />of the proposed <br />9-105 of current <br /> <br />Ordinance <br />Ordinance <br /> <br />7) Section 2-800: <br /> <br />Ci tizen comment indicates that this section, which establishes <br />the land use districts under the proposed Ordinance in the City <br />of LaPorte, indicate, based upon "restrictions", which uses are <br />more restrictive and which are less restrictive. <br /> <br />It should be noted that the proposed Ordinance, unlike our <br />current zoning Ordinance, does not provide for the inclusion of <br />residential uses in commercial or industrial districts, or <br />commercial uses in industrial districts, unless said residential, <br />commercial, or light industrial uses are specifically allowed <br />within a particular district as a permitted, conditional, or <br />accessory use as listed in the SIC Tables for each particular <br />zoning classification. The proposed Ordinance, through the use <br />of the SIC Codes, clearly outlines which uses are permitted, <br />
