Items ~3 an~4, Sections 11-101 and 11-102: <br /> <br />These two sections deal with building permits and their <br />expiration. In process of reviewing this with the <br />consultants, it was felt that these sections should mesh <br />with ordinances already on the books. Staff <br />recommendation that both sections be left as written. <br /> <br />4. Item ~5 Section 11-606(2) (c) (2) <br /> <br />Citizen comment indicates that "unnecessary hardships" be <br />changed to include economic hardship. Zoning Board of <br />Adjustments deals with four basic areas which only a few <br />are pertinent here. One being the granting of variances <br />which is the situation in which a specific requirement in <br />this ordinance should not be met due to unusual lot shape <br />topography and the application of the ordinance makes it <br />very difficult if not impossible for a land owner to <br />develop his land due to application of the ordinance. It <br />is the appeal mechanism. To get a variance from the board <br />of adjustment, you must show "hardship". It is not an <br />easy thing to get this hardship, so therefore we recommend <br />this part remain the same. <br /> <br />5. Item ~6 Section 11-612 <br /> <br />Basically a question pertaining to policy. Citizen <br />comment recommends that an applicant who is denied a <br />variance, special exception or appleal would not pe able <br />to reapply for a new variance, special exception, or <br />appeal from a determination of the zoning administrator <br />from the board of adjustment for a period of six months <br />after the original denial. Staff recommends that we leave <br />this section as is which is 1 year. . <br /> <br />Chairman Wilson asked for a motion to take staff's <br />recommendation on Section 11 Items 33-36. Commissioner Lola <br />PhilliDS made the motion, Seconded by Mrs. Graves, Motion <br />carried with no oDposition. <br /> <br />6. Item ~7 R-i Zone: <br /> <br />Citizen input indicates that the high density residential <br />zone in the proposed Ordinance is not necessary. <br />Staff recommends that the R-3 residential district <br /> <br />'... <br /> <br />..-- - <br />
