Consistent with the Cable Actt the Grantee shall at all times <br /> <br /> <br />employ a reasonable standard of care and shall instant maintain and use approved methods and <br /> <br /> <br />devices for preventing failures or accidents which are likely to cause damaget injury or nuisance to <br /> <br /> <br />the public. <br />6. No Obscenity. Cable Services that are obscene and not protected by the United <br />States Constitution or otherwise unprotected by the United States Constitution shall not be <br />provided. <br />7. Customer Service. The Grantee shall provide good customer service in accordance <br />with all regulations and guidelines of the FCC. In additiont Grantee shall maintain a customer <br />service center for the receipt of paymentst exchange of equipmentt and to provide personal <br />customer servicet either within the City or no greater than ten miles outside its corporate limits. <br />Section 10. EMERGENCY USE OF THE CABLE SYSTEM. The Grantee shall <br />comply with all rules and regulations of the FCC regarding emergency alert systems. <br />Section 11. PUBLIC, EDUCATIONAL AND GOVERNMENT ACCESS. Initially the <br />Grantee shall continue to provide one (1) downstream Channel on the Cable System for Publict <br />Educational and/or Government Access programming. The Grantee shall provide up to a total of <br />four (4) downstream Channels for the carriage of Publict Educational and Government Access <br />programmingt subject to the utilization thresholds below. Whenever each Access Channel is being <br />used for nonrepetitive locally produced programming (excluding character generated programming) <br />more than eighty percent (80%) of the hours between 11 a.m. and 11 p.m.t during any twelve (12) <br />consecutive week periodt the Grantee shallt upon receipt of written notice from the Cityt make an <br />additional Access Channel available within one hundred twenty (120) days.
