<br />e <br /> <br />e <br /> <br />provide Subscriber information in violation of Section 631 of the Cable Act. <br /> <br /> <br />3. Annual Report. A report shall be filed by the Grantee with the Director within sixty <br /> <br /> <br />(60) days following the end of each calendar year, or portion thereof, during which this Franchise is <br /> <br /> <br />in effect, which report shall include the Gross Revenues for such calendar year, or portion thereof, <br /> <br /> <br />and the number of Subscribers as of December 31 of the preceding year. <br /> <br /> <br />The report shall be certified by an appropriate representative of the Grantee, and shall <br /> <br /> <br />include any such other information as the Director may reasonably demonstrate as necessary to the <br /> <br /> <br />enforcement of the terms of the Franchise The Director may audit the books and records of the <br /> <br /> <br />Grantee to verify the amount of franchise fee owed and paid as well as compliance with other <br /> <br /> <br />provisions of this Franchise. <br /> <br /> <br />4. False Entry. Any false entry in the books or accounts and records of the Grantee or <br /> <br /> <br />false statement in the reports to the City as to a material fact, knowingly made by the Grantee, shall <br /> <br /> <br />constitute a violation ofa material provision of this Franchise. <br /> <br /> <br />5. FCC Filings. The Grantee shall, upon request, file copies of all reports and filings <br /> <br /> <br />made to the FCC with the Director. <br /> <br /> <br />Section 22. PROHIBITION OF DISCRIMINATORY PRACTICES. Access to Cable <br /> <br /> <br />Service shall not be denied to any group of potential Subscribers because of the income of the <br /> <br /> <br />residents of the local area in which such group resides or for any other reason. In providing Cable <br /> <br /> <br />Service, Grantee shall not discriminate in any way between or among Subscribers. This section <br /> <br /> <br />shall not be construed to require the Grantee to serve individual Subscribers that do not pay the <br /> <br /> <br />Grantee's regular charges in a timely manner, or to prohibit the charging of deposits to individual <br /> <br /> <br />Subscribers with poor credit histories, or to preclude promotional campaigns intended to attract or <br /> <br /> <br />maintain Subscribers, as long as such campaigns are non-discriminatory in nature. <br /> <br />22 <br />
