<br />'e <br /> <br />e <br /> <br />ORIGINAL <br /> <br />ORDINANCE NO. 98-..zzn.o <br /> <br />AN ORDINANCE RENEWING THE GRANT OF A NON-EXCLUSIVE FRANCHISE TO <br />TELE- VUE SYSTEMS, INC., ITS SUCCESSORS AND ASSIGNS, TO CONTINUE <br />OPERATION OF THE RIGHT, PRIVILEGE, AND FRANCHISE TO ERECT, MAINTAIN <br />AND OPERATE A CABLE TELEVISION SYSTEM IN THE CITY OF LA PORTE, TEXAS; <br />CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE GRANTING OF <br />TinS FRANCHISE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, on January 9. 1980, the City of La Porte, Texas (the "City") passed and <br />approved Ordinance No. 1775 granting a cable television franchise (the "Franchise") to Kip-Lee <br />CATV, Inc. ("Kip-Lee"); and <br /> <br />WHEREAS, on March 14, 1988, the City passed and approved Ordinance No. 1175-A <br />consenting to the transfer of the Franchise from Kip-Lee to Prime Cable of Ft. Bend, L.P., a <br />Delaware limited partnership ("Prime"); and <br /> <br />WHEREAS, on March 18, 1996, the City passed and approved Ordinance No. 96-2095 <br />consenting to the transfer of the Franchise from Prime to Tele-Vue Systems, Inc., a Washington <br />corporation ("Grantee"); and <br /> <br />WHEREAS, pursuant to the Communications Act of 1934, as amended by the Cable <br />Communications Policy Act of 1984, and Section 4 of the Franchise, Grantee has requested that the <br />City renew the Franchise; and <br /> <br />WHEREAS, the City Council of the City of the City of La Porte has concluded full and <br />open public hearings during which it has identified the future cable related community needs and <br />interests and has reviewed the performance of Grantee under the Franchise, and during which it has <br />also reviewed the adequacy of the ordinance granting the Franchise; and <br /> <br />WHEREAS, the City Council of the City of La Porte has found that Grantee has <br />substantially complied with the material terms of the Franchise and with applicable law; that the <br />quality of Grantee's service, including signal quality, response to consumer complaints and billing <br />practices, has been reasonable in light of community needs; and that Grantee has the financial, legal <br />and technical ability to provide those services, and facilities and equipment necessary to meet the <br />future cable related community needs and interests. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LA PORTE: <br /> <br />Section 1. SHORT TITLE. This ordinance shall be known and may be cited as the City <br /> <br />of La Porte-Tele-Vue Cable Television Franchise Ordinance. <br /> <br />1 <br />
