<br />e <br /> <br />e <br /> <br />Section 2. DEFINITIONS. For the purposes of this Franchise the following terms, <br /> <br /> <br />phrases, words, abbreviations and their derivations shall have the meaning given herein. When not <br /> <br /> <br />inconsistent with the context, words used in the present tense include the future tense, words in the <br /> <br /> <br />plural number include the singular number, and words in the singular number include the plural <br /> <br />number. The headings contained in this Franchise are to facilitate reference only, do not form a <br /> <br />part of this Franchise, and shall not in any way affect the construction or interpretation hereof. <br /> <br />Terms such as "hereby", "herein", "hereof', "hereinafter", "hereunder", and "hereto", refer to this <br /> <br />Franchise as a whole and not to the particular sentence or paragraph where they appear, unless the <br /> <br />context otherwise requires. The term "may" is permissive; the terms "shall" and "will" are <br /> <br />mandatory, not merely directory. All .references to any gender shall be deemed to include all <br />others, as the context may require. <br /> <br />"Anniversary Date" shall mean the date on which this Franchise becomes effective and each <br /> <br /> <br />annual anniversary thereof. <br /> <br /> <br />"Anniversary Year" shall mean the twelve month period following an Anniversary Date. <br /> <br /> <br />"Basic Cable Service" shall mean any service tier(s) offered or provided to all of its <br /> <br /> <br />Subscribers, which include(s) the transmission of local (greater Houston metropolitan area) <br />television broadcast signals. <br /> <br /> <br />"Cable Act" shall mean the Communications Act of 1934, as amended by the Cable <br /> <br /> <br />Communications Policy Act of 1984, the Cable Television Consumer Protection and Competition <br /> <br /> <br />Act of 1992, the Telecommunications Act of 1996, and as may be further amended from time to <br /> <br /> <br />time. <br /> <br />"Cable Service" shall mean the one-way transmission to Subscribers of video programming <br /> <br /> <br />or other programming service that a cable operator makes available to all Subscribers generally, and <br /> <br />2 <br />
