Where a lot of record at the time of the effective date <br />of this ordinance is less than fifty (SO) feet in width, <br />the required side yard may be reduced to provide a minimum <br />buildable width of thirt~ (30) feet: provided, however, that <br />no side ~ard shall be less than five (S) feet. <br /> <br />S. The area required in a yard shall be open to the sky, <br />unobstructed except for the ordinar~ projections of window <br />sills, belt courses, cornices or other ornlmental features. <br /> <br />6. A roof overhang, an open fire escape or an outside <br />stairwa~ ma~ project not more than three (3) feet into a <br />required side ~ard, but not closer than three (3) feet to <br />a propert~ line. <br /> <br />13.04 Rear Yards <br /> <br />An accessor~ building not exceeding twent~ (20) feet in height <br />nor closer than three (3) feet to an~ rear or side lot line ma~ be <br />located in the required rear yard; provided, sucb accessor~ building <br />does not occupy more than twent~-five (25) percent of tbe total area <br />of the required rear ~ard. Unenclosed parking spaces sball not <br />occup~ more than eigbt~ (80) percent of tbe total required rear yard. <br /> <br />SECTION 14 <br /> <br />Special Use Regulations <br /> <br />Special uses ma~ be autborized b~ a special permit granted by tbe <br />Board of Adjustment in appropriate class and subject to certain cond- <br />itions and safeguards as migbt be required b~ tbe Board of Adjustment. <br />The Board shall in a reasonable time for a bearing of tbe applicantion, <br />give public notice thereof, as well as due notice to the parties in <br />interest, and decide the same within a reasonable time. Upon tbe bear- <br />ing, any party may appear in person or by agent or by attorney. <br /> <br />The purpose of such hearing by the Board shall be to determine that <br />the granting of the special permit will not adversely affect the char- <br />acter and appropriate use of the area or neighborhood in which it is <br />proposed to locate; will not substantially depreciate the value of <br />adjacent and nearby properties for use in accordance with tbe re- <br />gulations of the zoning district in whicb the~ are located; and will <br />be in keeping'witb the spirit and intent of this Ordinnce: will not <br />adversely affa~t traffic, public utilities, public health, public safety <br />and the generai welfare. ' <br /> <br />All applications for special permits shall be submitted with plans, <br />in sufficient detail to determine the proposed use of the entire premises <br />as well as all buildings and structures, to the City Inspector who <br />shall file and report on the same to the Board of Adjustment. <br /> <br />-33- <br />
