At times during and after <br />inclement weather when the risk of damage to turf areas are high, HL&P may <br />delay initiation of installation or repair work until conditions are more suitable and <br />damage is less likely to occur. The City will ultimately be responsible for repair <br />of any turf damage that may occur as a result of HL&P trucks on site. <br /> <br />7. HL&P will replace burned out lamps and/or make maintenance repairs during <br />regular working hours at its own cost and expense and will normally have the <br />lighting service restored within forty-eight (48) hours after notification of failure <br />by the City. Lights furnished hereunder shall operate under normal conditions <br />from approximately thirty minutes after sunset to approximately thirty minutes <br />before sunrise every night in the year and the total time of operations will be <br />approximately four thousand (4,000) hours each year for each light furnished. <br />HL&P will commit to and assume the costs for a paint cycle of every fifteen (15) <br />years. HL&P will use the same color of available paint at the time of re-painting. <br /> <br />8. The City shall be responsible for all costs of electricity under rate schedule Street <br />and Protective Lighting Service (SPL), or any succeeding rate schedule as may <br />be approved by the appropriate regulatory agency from time to time, used or in <br />connection with the operation of the Decorative Lighting installed. The Tariff for <br />electrical service, including without limitations any applicable rate schedule and <br />agreements, shall take precedence over this agreement. Attached hereto is a <br />copy of the current SPL schedule, referenced as Exhibit "A". The current <br />applicable Monthly Rate per Lamp, including adjustment and fuel charge, for the <br />Decorative Lighting System contemplated at Glen Meadows Park and described <br />herein for High Pressure Sodium Vapor lighting, 9,500 Lumens, Schedule D, is <br />Fifteen Dollars and Sixty-six Cents ($15.61) for each light installed in the <br />contemplated system. <br /> <br />9. The City shall have the right, at its own expense, to hang decorative flags and <br />banners on the decorative lighting poles, provided the City meets all <br />requirements as set forth in the Banner Agreement attached hereto as Exhibit <br />"B". Decorations other than flags or banners shall receive approval from the <br />Lighting Design and Service Department prior to installation Under no <br />circumstances will HL&P or the City approve the installation of signage that is <br />necessary for safe traffic operation, including but not limited to STOP and YIELD <br />signs. The City shall be responsible for the costs of repairing any damages to <br />the Decorative Lights resulting directly or indirectly from such signage, as well <br />as the removal of such signage from the decorative lighting poles. <br /> <br />Decorative Lighting Agreement, page 3 of 7 <br />
