<br />bE~cause of' inad equate maintenance, dilapi~ation, obsolescence, or abandonment;
<br />
<br />or otherwise dangerous to life or property.
<br />
<br />SECTION 9. PENALTY FOR VIOLATIONS.
<br />
<br />(a) A person who shall violate a provision of this Ordinance or f ail
<br />tc:> comply therewith or with a:ny of the requirements thereof, or who shall erect,
<br />
<br />ct,pstruct, alter or repair, or has erected, constructed, altered or repaired a
<br />
<br />building or structure, in violation of a detailed statement or plan submitted and
<br />
<br />approved thereunder, or of a permit or certificate issued thereunder, shall be
<br />
<br />guil ty of a misdemeanor punis~able by a fine of not less than ten dollars nor
<br />moore than one hundred dollars.
<br />
<br />(b) The owner of a building, structure or premises, where anything
<br />i.:n violation of this Ordinance shall be placed or shall exist, and an architect,
<br />builder, contractor, agent, person or corporation employed in connection therewith
<br />
<br />a:nd who may have assisted in the commission of such violation shall each be guilty
<br />
<br />o.r a separate offense and upon conviction thereof shall be fined as therein provided.
<br />
<br />(c) The imposition of the penalties herein prescribed shall not preclude
<br />
<br />the corporation counsel from instituting an appropriate action or proceeding to
<br />
<br />prevent an unlaw.f'ul erection, construction, reconstruction, alteration, repa:ir,
<br />
<br />conversion, maintenance, or use, or to restrain, corre,ct or abate a violation,
<br />
<br />o:r to prevent the occupancy of a building, structure or premises, or to prevent
<br />
<br />a:n illegal act, conduct, business or use in or about any premises.
<br />
<br />SECTION 10. DEFlNITIONS.
<br />
<br />ALTER!TI:ON, as applied to a building or structm-e, means a change or
<br />rearrangement in the structuraJ. parts m: :in the ent facilities; or an enlargement,
<br />y,rhether by ex tending on a side or by increasing in height; or the moving from one
<br />
<br />location or position to another; the term "alter" in its various moods and tenses
<br />and its participiaJ. forms, re.ters to the making of an alteration.
<br />
<br />AMUSEMENT DEVICE means a mechanically operat~d device which is used to
<br />convey persons in any direction as a form of' amusement.
<br />
<br />APARTMENT means a room, or a suite of two or more rooms, in a residence
<br />
<br />building occupied as the home or residence of an individual, family or household.
<br />
<br />APPROVED, as applied to a material, device or mode of construction,
<br />means approved by the building official lUlder the provisions of this Ordinance,
<br />or by other authority designated by law to give approval in the matter in question.
<br />AREA, as applied to the dimensions of a building, means the maximum
<br />horizontal projected area of the building at grade.
