Duncan, Jr., <br />Houston, Texas that he intends to use his best efforts to arrange for the <br />development of 219 acres of land on the west side of Highway 146, north and <br />adjacent to Shore Acres and that in order to properly develop this area he <br />desires to create a fresh water supply district to provide water and sewer <br />facilities in this area. <br />The City of La Porte has already passed an ordinance annexing this <br />area on first reading. Sl10uld this annexation be completed before the water <br />district can be formed and can issue and deliver its bonds, then this allllexa- <br />tion would completely stop and would dissolve the water district. Therefore <br />Mr. Duncan has requested the City to give him an expression to the effect <br />that the City has no objection to the creation of this district and that it <br />does not intend to oomplete the annexation until the district has been completed <br />and funds have been made available for the construction of water and sewer <br />facilities. <br />Whereas the State Statutes provide that when a city annexes an <br />entire fresh water supply district or water control and improvement district <br />then the City acquires all of the assets of this district and assumes all of <br />the debts of this district. It is the position of the City of La Porte that <br />it is fully justified in asking that the developer agree to the following <br />conditions: <br />(a) It is intended that the Board of Supervisors of the <br />proposed District will submit to the City of La Porte <br />all pl~ns and specifications for the construction of <br />water and sewer facilities and that these plans and <br />specifications meet the City of La Porte standards. <br /> <br />(b) That all water and s~ver facilities constructed ,vill be <br />so designed that they vall be readily integrated with the <br />City of La Porte facilities should they be extended to <br />this area. <br />
