<br />e <br /> <br />e <br /> <br />. <br /> <br />Artic Ie 62.0--15 <br />NON-CONFORMING USES <br />1. Any use of property that does not conform to the <br />regulations prescribed in the preceding articles of this <br />ordinance and which shall have been in existence prior to <br />July 29, 1958 , shall be called a non-con- <br />forming use. <br />2. Any non-conforming use of land or structure may be <br />continued for definite periods of time and subject to such <br />regulations as the Board of Adjustment may require for immed- <br />iate preservation of the adjoining property and the ultimate <br />removal of the non-conforming use. The Board of Adjustment <br />may grant a change of occupancy from one non-conforming use <br />to another, providing the use is within the same, or higher <br />classification as the original non-conforming use; provided, <br />however, that such change of use and occupancy will not tend <br />to prolong and continue the non-conforming use. A non-con- <br />forming use may be changed to a use authorized in a "B" <br />Commercial or higher classification use district, without <br />obtaining a permit from the Board of Adjustment, provided it <br />is not a change from a higher to a lower classification use. <br />A non-conforming use once changed from a lower to a higher <br />classification use shall not be changed to a lower classifica- <br />tion use, and such prior lower classification use shall be <br />considered abandoned. <br />3. A non-conforming use shall not be extended or rebuilt <br />in case of obsolescence or total destruction by fire or other <br />cause. In case of partial destruction by fire or other causes, <br />not exceeding 50 % of its value, the Building Inspector shall <br />issue a permit for reconstruction. <br />If greater than 50% and less than total, the Board of Ad- <br />justment may grant permit for repair after public hearing and <br />having due regard for the property rights of the persons affect- <br />ed when considered in the light of the public welfare and the <br />character of the area surrounding the designated non-conforming <br />use and the conservation and preservation of property. <br />4.
