Violation of this ordinance and a request for a non- <br />conforming designation or request for relief under this design- <br />ation shall not create an esto~l of the trial of any law suit <br />which may be filed in any court. <br />6. Country clubs, private golf courses, maintaining a <br />standard nine hole course or more, fraternal clubs, athletic <br />clubs, tennis clubs or other private bona fide olubs, which <br />have had a permit to sell beer for on-the-premise consumption <br />on July 29. 19~~ , may have such permit renewed as <br />a non-conforming use; provided, however, that if the operation of <br />such club or golf course by reason of the sale of beer creates <br />a nuisance in the neighborhood, then in that event, the Board <br />of Adjustment upon due notice and a public hearing may revoke <br />such permit and thereafter no new permit may be granted at such <br />location. <br />The sale of beer, liquor or wine for consumption off the <br />premises, which had a permit on July 29, 1958_, may be <br />continued and a permit therefor may be granted or renewed in <br />any "B" Commercial District except B-2 and B-4 or lower class- <br />ification non-conforming use, or that may hereafter become a <br />non-conforming use of the same character; provided, however, that <br />if the sale of beer or liquor creates a nuisance through the <br />viiation of the character of license that is granted, then the <br />Board of Adjustment upon due notice and a public hearing may <br />revoke such permit and thereafter no renewal permit may be <br />granted at such location. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />61 <br />
