Box 1115 La Porte, Texas 77571 Dear Ladies and Gentlemen: In connection with the proposed landscape ordinance, which is drafted as an add i tion to the City: of La Porte zoning ordinance, Ordinance No. 780, you have requested my opinion on the necessity of a public hearing before the Planning and Zoning Commission, prior to final action on this ordinance by the City Council. Section 17-101 of Ordinance No. 780 reads as follows, to-wit: "17-101 Public Hearing Before the City Planning and Zoning Commission. Before taking any action to any trOposed amendment, supplement, change, or modi- ication, the City Commission shall submit the same to the City Planning and Zoning Commission which shall make a preliminary report and hold a public hearing hereon before submitting its final report to the City Commission." This may be accomplished as a joint pUblic hearing before the Planning and Zoning Cpmmission and the City Council, as under our previous practice, or, in the alternative, with a public hearing first before the Planning and Zoning Commission, and another pUblic hearing at a later date~before the City Council, at your election. ' As in the case of changes of zoning classifications, Ordinance No. 780, and also, Article 1011d, Revised Civil Statutes, requires at least fifteen (15) days notice of the time and place of the public hearing be published in the official newspaper of the City of La Porte.
