<br />e <br /> <br />e <br /> <br />City of La Porte <br />La Porte, Texas <br /> <br />Page 4 <br />11/23/82 <br /> <br />3. ,The Director of Engineering (or his designated repre- <br />sentative) and the Zoning Officer (or his designated <br />representative) shall present a factual summary relative <br />to the proposed rezoning~. <br /> <br />4. Chairperson shall call on persons wishing to speak as <br />to the proposed rezoning, including: <br /> <br />(a) The applicant' or his representative~ <br />(b) Persons in support of the request~ <br />(c) Those persons in opposition to the request~ <br />(d) Opportunity for rebuttal is provided~ and <br />(e) The commission shall ask any further <br />questions of the applicant, his repre- <br />sentative, or others with knowledge of <br />the proposed rezoing. <br /> <br />(8) The City Secretary (or ,his designated representative) shall <br />attend all regularly scheduled meetings and public hearings of <br />the Planning and Zoning Commission of the City of La Porte, and <br />record all proceedings thereof. <br /> <br />(9) Motion is made by a member of the commission to either recommend <br />rezoning to the City Council, to deny a recommendation of rezoning <br />to the City Council, or to modify the application and recommend <br />the modified rezoning scheme to the City Council. In order to <br />recommend rezoning to the City Council (either as applied for, <br />or as modified by the Planning and Zoning Commission of the <br />City of La Porte), four (4) affirmative votes are necessary. <br /> <br />(10) The Planning and Zoning Commission shall submit its decision on <br />the proposed rezoning in writing to the City Council, by trans- <br />mitting same to the City Secretary. Any dissenting votes on <br />the commission shall be recorded in writing and transmitted <br />along with the commissionls decision to the City Council, along <br />with any dissenting written opinions the Planning and Zoning <br />Commission of the City of La Porte may wish to include with its <br />recommendation. <br /> <br />(11) The City Council shall schedule a public hearing, subsequent to <br />at least fifteen (15) days notice by publication in the La Porte- <br />Bayshore Sun, said notice to include all the information contem- <br />plated in paragraph (6) above. Said public hearing shall be an <br />open meeting. The public hearing before City Council should <br />follow substantially the same format as the public hearing <br />before the Planning and Zoning Commission of the City of La <br />
