<br />e <br /> <br />e <br /> <br />City of La Porte <br />La Porte, Texas <br /> <br />Page 5 <br />11/23/82 <br /> <br />Porte, except that the recommendation o,f the Planning and Zoning <br />Commission shall be read initially, along with the information <br />regarding the proposed rezoning as provided in paragraph (7) <br />above. The public hearing shall then be closed. <br /> <br />(12) Council may vote to either accept the proposed rezoning, reject <br />it, or modify Planning and Zoning Commission's recommendation. <br />Said vote may be taken at a regularly scheduled meeting of the <br />City Council, held on the same night as the public hearing, or <br />a t a subsequent, regularly scheduled meeting of City Council. <br />No rezoning is effective until an ordinance has been passed by <br />Ci ty Council. In the' case of a recommendation of rezoning by <br />the City Planning and Zoning Commission, the City Council may <br />pass the rezoning ordinance by a simple majority. In the case <br />of a recommendation by the Planning and Zoning Commission of <br />the City of La porte against rezoning the subject property, <br />seven (7) council member votes in favor of the proposed rezoning <br />are needed to pass the rezoning ordinance. Regardless of <br />Planning and Zoning Commission's recommendation, in the case <br />of a written protest by twenty per cent (20%), or more, either <br />of the area of the lots or land included in such proposed change, <br />or of the lots or land immediately adjoining the area affected <br />by the proposed change and extending two hundred (200) feet <br />therefrom, seven (7) council member votes in favor of the <br />proposed rezoning ordinance are required in order to pass <br />the proposed rezoning ordinance. (Vernon's Annotated Texas <br />Statutes, Article 1011e(a). <br /> <br />(a) It shall be the duty of the City Secretary, in the case <br />of a written protest, to ascertain from the city tax <br />rendition rolls mentioned above, the owners of twenty per <br />cent (20%), or more, either of the area of the lots or land <br />included in such proposed change, or of the lots or land <br />immediately adjoining the land included in the proposed <br />change. <br /> <br />(b) The form of protest shall contain the following information, <br />or its substantial equivalent: <br /> <br />1. Name of the protestant; <br /> <br />2. Address of the protestant; <br /> <br />3. Legal description of the property of the <br />protestant; <br />
