<br />. <br /> <br />e <br /> <br />1.6.12 <br /> <br />Limitation of Responsibilities <br /> <br />ARCHITECT shall not be responsible for the acts or <br />omissions of any Contractor, or of any subcontractor or supplier, <br />or any of the Contractor(s) or subcontractor's or supplier's agents <br />or employees or any other persons (except ARCHITECT's own employees <br />and agents) at the site or otherwise furnishing or performing any <br />of the contractor(s)' work; however, nothing contained in <br />paragraphs 1.6.1 through 1.6.11 inclusive, shall be construed to <br />release ARCHITECT from liability for failure to properly perform <br />duties and responsibilities assumed by ARCHITECT in the Contract <br />Documents. <br /> <br />1.7 Operational Phase <br /> <br />During the operational Phase, ARCHITECT shall: <br /> <br />1.7.1 Furnish the deliverable items referred to in <br />Section 1.6.10 and in the Operational Phase and present and review <br />them in person with OWNER. <br /> <br />1.7.2 Define in Contract Documents the Contractor(s) (and or <br />Vendor(s)) responsibility in connection with the start up, <br />refining, and adjustment of any equipment or system. <br /> <br />1.7.3 Define in Contract Documents the Contractor(s) (and or <br />Vendor(s)) responsibility for training owners staff to operate and <br />maintain any equipment or system and for reviewing pertinent <br />manuals, submittals, shop drawings, and warranties supplied by the <br />Contractor(s), Vendor(s), or Manufacturer(s) as the case may be. <br /> <br />1.7.4 Coordinate, attend and participate in the start up and <br />training orientations as described in paragraphs 1.7.2 and 1.7.3. <br />1.7.5 Record Drawings. <br /> <br />ARCHITECT shall furnish the OWNER a set of marked up <br />prints, drawings and other data kept by the Contractor(s), and <br />Project Representative (if employed by the ARCHITECT) in a form and <br />manner that clearly depicts significant changes made during the <br />construction process. <br /> <br />1.7.6 At a time eleven (11) months following Substantial <br />Completion of the project (one month prior to expiration of the <br />Contractor's warranty period), the ARCHITECT, in the company of the <br />OWNER, will visit the project to observe any apparent deficiencies <br />in the completed construction, and document any items observed in <br />a written report issued to the CONTRACTOR and OWNER. <br /> <br />1-10 <br />
