Additional <br />electrical service, plumbing or drain lines shall be approved'by <br />the Parks and Recreation Director prior to planning installation, <br />and approved by the City Building Official. Actual installation <br />shall be according to all applicable State laws, regulations and <br />ordinances of the City of La Porte. Contractor must also provide <br />approved filters for any and all exhaust systems he may utilize or <br />install. <br /> <br />4. LIABILITY: The City of La Porte, its officers and employees shall <br />be held free and harmless from any liability occasioned by any <br />cause whatsoever arising from the performance of the contract. <br /> <br />5. INSURANCE: Contractor shall submit for approval by the City <br />Attorney of the City of La Porte and retention by the City, <br />insurance policies or certificates showing the Lessee has in force <br />policies with limits equal at least to the following: <br /> <br />a) Worker's Compensation and Employer's Liability Insurance, as <br />pr~scribed by Texas Law. <br /> <br />b) Comprehensive General Liability with limits of <br />$100,000.00/$300,000.00 per occurrence. Property damage <br />insurance with limits of $100,000.00 per occurrence. <br /> <br />c) Comprehensive automobile liability insurance: <br />1. Bodily InJury - each person, $100,000.00 <br />2. Each Occurrence - $300,000.00 <br />3. Property Damage - $25,000.00 <br /> <br />d) The City of La Porte is to be named as additional insured on <br />each policy. <br /> <br />e) Thirty (30) days notice to City of La Pore, Attention: City <br />Manager, prior to cancellation. <br /> <br />6 . <br /> <br />CONTRACT BOND: A bond of Faithful Performance of every <br />requirements of the contract, in the amount of $5,000.00 <br />furnished concurrent with the execution of the contract. <br />of a bond, a negotiable Certificate of Deposit from <br />Harris County, Texas may be furnished. <br /> <br />and all <br />shall be <br />In lieu <br />a bank in <br /> <br />7. TERM OF CONTRACT: The term of the contract will be for a period <br />of thirty-six (36) months, with the option on the part of City to <br />extend for an additional twelve (12) month period, subJect to <br />suspension and cancellation as provided in the form of Lease <br />Agreement attached hereto. <br /> <br />8. AUTHORITY OF THE PARKS AND RECREATION DIRECTOR: The Parks and <br />Recreation Director shall decide any and all questions which may <br />arIse as to the acceptability or services rendered and as to the <br />manner of perCormance; all questions which arise as to the <br />interpretation of the conditions and specifications; all questions <br />as to the acceptable fulfillment of this contract. <br /> <br />9. SUSPENSION OF THE CONTRACT: If at any time in the opinion of the <br />Parks and Recreation Director the Lessee has failed to render <br />services of proper quality, or has failed in any other respect to <br />perform as specified and intended in and by terms of the contract, <br />notice thereof in writing will be served upon him, and should he <br />neglect or refuse to provide means for a satisfactory compliance <br />with the Lease, as directed by the Parks and Recreation Director, <br />within the time specified in such notice, the Parks and Recreation <br />Director shall have the power to suspend the operation of the <br />contract. Upon such suspension the Lessee's control shall <br />terminate and thereupon the City Council of the City of La Porte <br />or its duly authorized representative may employ other parties to <br />carry the contract to completion in such manner as the City <br />Council may deem proper; or the City Council may cancel the <br />contract and re-Iet it.
