However, these requirements apply <br />to the rehabilitation of residential property only if such property <br />contains not less than 8 units. <br /> <br />VI. <br /> <br />NATIONAL FLOOD INSURANCE PROGRAM <br /> <br />The City shall comply with the Flood Disaster Protection Act of <br />1973 (42 U.S.C. 4106) which prohibits financial assistance for <br />acquisition or construction purposes 1n any area that has been <br />identified by the Director of the Federal Emergency Management Agency <br />as a area having special flood hazards unless the community in which <br />such area is situated is then participating in the National Flood <br />Insurance Program in accordance with 44 CFR Parts 59-79, or less than <br />a year has passed since FEMA notification to the community regarding <br />such hazards; and flood insurance is obtained in accordance with <br />Section 102(a) of the Flood Disaster Protection Act of 1973 (42 U.S.C. <br />4001) . <br /> <br />VII. <br /> <br />RELOCATION, DISPLACEMENT AND ACQUISITION ASSISTANCE <br /> <br />The Uniform Relocation and Real Property Acquisition Policies Act <br />of 1970 (42 USC 46.01) and HUD implementing regulations of 24 CFR 42 <br />apply to the acquisition of real property by the City for an activity <br />assisted under this part and to the displacement of any family, <br />individual, business, non-profit organization or firm that results <br />from such acquisition. <br /> <br />The City shall comply with the prov1s1ons of the Uniform <br />Relocation Act as contained in 24 CFR Part 570.606. All occupied and <br />vacant occupiable low/moderate income dwelling units that are <br />demolished or converted to a use other than as low/moderate income <br />dwelling units as a direct result of a federally funded activity must <br />be replaced as described in 24 CFR 570.606(b) (1) and each low- or <br />moderate income household that is thereby displaced shall be provided <br />with relocation assistance as described in 24 CFR 570.606(b) (2). <br /> <br />Reasonable relocation assistance must be provided to persons <br />(families, individuals, business, non-profit organizations or firms) <br />displaced (i.e., moved permanently and involuntarily) as a result of <br />Federal assistance to acquired or substantially rehabilitate property <br />as described in 24 CFR 570.606(c). <br /> <br />3 <br />
