<br />. <br /> <br />e <br /> <br />VIII. <br /> <br />EXECUTIVE ORDER 11246 <br /> <br />The City shall comply with Executive Order 11246, as amended by <br />Executive Order 12086, and the regulations issued pursuant thereto (41 <br />CFR Chapter 60) which provides that no person shall be discriminated <br />against on the basis of race, color, religion, sex, or national origin <br />in all phases of employment during the performance of Federal or <br />federally assisted construction contracts. <br /> <br />ci ty agrees that contractors and subcontractors on Federal or <br />federally assisted construction contracts shall take affirmative <br />action to ensure fair treatment in employment, upgrading, demotion or <br />transfer, recruitment or recruitment advertising, layoff or <br />termination, rates of pay, or other forms of compensation and <br />selection for training and apprenticeship. <br /> <br />IX. <br /> <br />SECTION 3 OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1968 <br /> <br />The City shall comply with Section 3 of the Housing and Urban <br />Development Act of 1968, as amended, (12 USC 1701u). <br /> <br />The City shall to the greatest extent feasible, give <br />opportunities for training and employment to lower income residents of <br />the County and shall award contracts for work in connection with the <br />Project to business concerns which are located in or owned in <br />substantial part by persons residing in the County. <br /> <br />The City shall include the phrase in the above paragraph in all <br />contracts for work in connection with this project. <br /> <br />X. <br /> <br />LEAD-BASED PAINT <br /> <br />The City shall comply with section 401(b) of the Lead-Based Paint <br />Poisoning Prevention Act (42 U.S.C. 4831(b)) as contained in 24 CFR <br />570.608 which prohibits the use of lead-based paint in residential <br />structures constructed or rehabilitated with Federal assistance. Such <br />prohibitions are contained in 24 CFR Part 35, Subpart B, and are <br />applicable to residential structures constructed or rehabilitated with <br />assistance provided under this part. <br /> <br />For properties constructed prior to <br />rehabilitation and tenants or purchasers of <br /> <br />1978, applicants <br />properties owned <br /> <br />for <br />and <br /> <br />4 <br />
