EXECUTIVE ORDER 11246 The City shall comply with Executive Order 11246, as amended by Executive Order 12086, and the regulations issued pursuant thereto (41 CFR Chapter 60) which provides that no person shall be discriminated against on the basis of race, color, religion, sex, or national origin in all phases of employment during the performance of Federal or federally assisted construction contracts. ci ty agrees that contractors and subcontractors on Federal or federally assisted construction contracts shall take affirmative action to ensure fair treatment in employment, upgrading, demotion or transfer, recruitment or recruitment advertising, layoff or termination, rates of pay, or other forms of compensation and selection for training and apprenticeship. IX. SECTION 3 OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1968 The City shall comply with Section 3 of the Housing and Urban Development Act of 1968, as amended, (12 USC 1701u). The City shall to the greatest extent feasible, give opportunities for training and employment to lower income residents of the County and shall award contracts for work in connection with the Project to business concerns which are located in or owned in substantial part by persons residing in the County. The City shall include the phrase in the above paragraph in all contracts for work in connection with this project. X. LEAD-BASED PAINT The City shall comply with section 401(b) of the Lead-Based Paint Poisoning Prevention Act (42 U.S.C. 4831(b)) as contained in 24 CFR 570.608 which prohibits the use of lead-based paint in residential structures constructed or rehabilitated with Federal assistance. Such prohibitions are contained in 24 CFR Part 35, Subpart B, and are applicable to residential structures constructed or rehabilitated with assistance provided under this part.
