<br />e <br /> <br />It <br /> <br />NOW, THEREFORE, the County and City do mutually agree as follows: <br /> <br />I. <br /> <br />SCOPE OF AGREEMENT <br /> <br />The County and City agree to complete and operate the Project in <br />accordance with the guidelines, rules, and regulations required by the <br />U. S. Department of Housing and Urban Development, hereinafter <br />referred to as "HUD." <br /> <br />II. <br /> <br />DUTIES OF THE COUNTY AND CITY <br /> <br />The City shall acquire the property in accordance with the <br />applicable provisions of the Uniform Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970, as amended, and subject to <br />the approval by the County through its Community Development Agency <br />(HCCDA) . The City agrees that by executing this agreement that it <br />shall be responsible for any and all Project costs that exceed the <br />Community Development Block Grant funds provided under this Agreement. <br />The City also agrees that, as part of its consideration for the <br />construction of the Project, it shall do the fOllowing (1.) Purchase a <br />vehicle equipped to transport handicapped persons to and from the <br />SPORT Center for participation in activities at the Center. The <br />purchase of such a vehicle by the City shall be completed by the time <br />the SPORT Center is opened to the public. (2.) Provide any and all <br />furnishings and equipment as may be appropriate for use of the <br />building as a recreation and therapy center for mentally and <br />physically disabled persons. <br /> <br />The County shall monitor and approve the acquisition of the <br />property (including the purchase price) to assure compliance with <br />community Development Block Grant rules and regulations. This shall <br />be done through the Harris County Community Development Agency. <br /> <br />The County shall be responsible for coordinating the design of <br />the Project subject to the approval by the City of the final design. <br />The County shall be responsible for the administration of the <br />construction contracts, with the City approving the award of the bid. <br />The City shall, at its own expense, furnish the necessary inspection <br />personnel to assure itself of compliance with the contract. In <br />absence of inspection by the City, then the City shall be deemed to <br />have accepted those inspections made by the County. The County shall <br />prepare and approve all requests for payments and payments to be made <br />under this agreement. The County shall fund the Project as set forth <br />in this agreement.
