<br />e <br /> <br />e <br /> <br />City of La Porte <br />Personnel Policies <br /> <br />A terminated or resigning employee shall receive their separation paycheck in accordance <br />with Article 5155 of the Revised Civil Statutes of Texas, which states: <br />(c) An employee who is discharged from employment must be <br />paid in full not later than the sixth day after the date the employee <br />is discharged. <br />(d) An employee who leaves employment other than by discharge <br />must be paid in full not later than the next regularly scheduled <br />payday. <br /> <br />Any employee who does not return City issued property shall have the cost of the <br />property deducted from their final paycheck. <br /> <br />SECTION 6 - OVERTIME PAY <br /> <br />Employees shall work overtime hours when necessary with the advanced approval of <br />their Department Director. All overtime eligible employees shall be compensated for any <br />approved overtime at a rate of one and one-half times their regular hourly rate. <br />Employees who regularly work forty (40) hours per week shall receive an overtime pay <br />rate for all hours worked above forty in the work week. A work week is defined as that <br />period of time between 12:01 a.m., Monday morning and midnight Sunday. <br /> <br />Under the Fair Labor Standards Act and amendments of 1985, the City of La Porte has <br />elected to utilize exception 7(k) and has established a 28 day work cycle for its <br />employees who regularly work 24 hour shifts. The recognized average work week for <br />these employees is 53 hours. For 24 hour shift personnel, the work week shall begin and <br />end at the start of the first work shift after Sunday midnight. <br /> <br />Calculation of overtime pay for 24 hour shift personnel shall be based on the number of <br />hours worked over 212 in a 28 day work cycle. Overtime pay will be calculated and <br />employees compensated for hours worked over 212 at the conclusion of the 28 day cycle <br />or every other payday. <br /> <br />Hours worked is defined for all personnel to mean hours of physical presence at a job <br />site and the following excused leaves: <br /> <br />1. Injury leave/worker's compensation <br />2. Approved holiday leave <br />3. Emergency leave <br />4. Jury service <br />5. Military leave <br />6. Vacation <br />7. Sick Leave <br /> <br />The following leaves shall not be construed as hours worked in the calculation of <br />overtime: <br /> <br />1. Administrative leave with pay <br />2. Authorized leave without pay <br /> <br />15 <br />
