<br />e <br /> <br />e <br /> <br />(b) In the event that the CITY authorizes abutting landowners to <br />occupy space under the surface of any street, alley, highway, or <br />public place, such grant to an abutting landowner shall be subject <br />to the rights of the TELEPHONE COMPANY described herein. In the <br />event that the CITY plans to close or abandon any RIGHT-OF-WAY which <br />contains any existing TELEPHONE COMPANY FACILITIES, CITY shall, if <br />requested by TELEPHONE COMPANY, (1) reserve a continuing right for <br />the TELEPHONE COMPANY'S FACILITIES, and (2) give notice of the date <br />the La Porte City Council is to consider the closure or abandonment. <br /> <br />(c) Whenever it shall be necessary to require TELEPHONE COMPANY to <br />alter, change, adapt, or conform its FACILITIES within the <br />RIGHT-OF-WAY, such alterations or changes shall be made promptly, <br />with consideration given to the magnitude of such alterations or <br />changes, without claim for reimbursement or damages against the <br />CITY. If such requirements impose a financial hardship upon the <br />TELEPHONE COMPANY, the TELEPHONE COMPANY shall have the right to <br />present alternative proposals to the CITY, and the CITY shall give <br />due consideration to any such alternative proposals. It is <br />understood and further provided, however, that the CITY shall not <br />require TELEPHONE COMPANY to remove its FACILITIES entirely from <br />such RIGHT-OF-WAY.
