<br />e <br /> <br />e <br /> <br />- 8 - <br /> <br />11. AMNESTY <br /> <br />Unannounced biological testing will not be conducted during a period of thirty days <br />immediately following the effective date of this policy. The purpose of an amnesty period is <br />to allow employees who are using illegal drugs to discontinue use without fear of detection <br />by unannounced testing, and to allow employees whose illegal drug use requires medical <br />assistance to enroll in rehabilitation programs without prejudice to their jobs. <br /> <br />Amnesty will not apply to biological testing for Pre-employment and Post-accident <br />situations. <br /> <br />12. CONFIDENTIALITY <br /> <br />All information relating to biological testing or the identification of persons as users of illegal <br />drugs and alcohol will be protected by the City as confidential, unless otherwise required by <br />law, overriding public health and safety concerns, or authorized in writing by the person in <br />question. <br /> <br />13. RESERVATION OF RIGHTS <br /> <br />The City may modify, rescind or change this policy without notice. In addition, this policy <br />shall not constitute nor be deemed a contract or promise of employment. <br /> <br />14. SAVINGS CLAUSE <br /> <br />If any part of this policy is held invalid by a competent authority, or by changes in local, <br />state or federal legislation or U.S. Department of Transportation regulations or rules, such <br />part shall be deemed invalid and the remainder of the policy shall continue in full force and <br />effect. <br />
