<br />SCU06-003 <br />Ju120,2006 <br />Page 3 of3 <br /> <br />Conclusion & <br />Recommendation: <br /> <br />Utilities, Drainage - The water system has a planned upgrade to provide <br />suitable fire protection. Existing 8" waterline is located on the west side of <br />the Powell Road right-of-way (ROW) and ends near the northeast comer of <br />Section 1, Phase I. A future 12" water line extension will serve the property <br />with domestic and fire service. Sanitary sewer service would be provided <br />through the existing 12" sanitary sewer line located to the northeast of the <br />development along Powell Road. Storm water facilities will be designed in <br />accordance with the City of La Porte and Harris County Flood Control <br />District requirements. The design of the storm water detention basin will be <br />reviewed with the site plan submittal and construction drawings. <br /> <br />The subject property is zoned Planned Unit Development (PUD). Any <br />development in a PUD zoning district requires a general plan along with a <br />Special Conditional Use Permit. The General Plan and Developer's <br />Agreement are the umbrella documents for this development. This proposed <br />project, therefore, cannot be considered in isolation of the principal <br />documents. Given that construction drawings for the entire park, the <br />Developer's Agreement, Covenants, Conditions, and Restrictions (CCRs) <br />are under review at this time, this SCUP does not go into effect until all <br />elements and supporting documents contained therein are submitted to the <br />Commission and approved by City Council. <br /> <br />Should the Commission wish to approve the SCUP in its present format, <br />staff recommends the following: <br /> <br />1. This SCUP does not go into effect until elements and supporting <br />documents contained therein are submitted to the Commission and <br />approved by the City. <br />2. This SCUP is not applicable to any other specific development <br />anticipated or proposed by this General Plan. <br />3. This SCUP outlines in general terms the proposed Planned Unit <br />Development. The developer recognizes and understands that any <br />future construction or development of the private or public <br />improvements anticipated by this SCUP and the General Plan shall <br />require further submittal and approval of plats, site plans, construction <br />drawings, engineering analysis, covenants, etc. <br />4. Said submittals shall be in accordance with the SCUP, the approved <br />General Plan, and the approved Development Agreement. <br />5. The Developer shall comply with all other applicable laws and <br />ordinances of the City of La Porte and the State of Texas. <br /> <br />Actions required by the Commission: <br /> <br />· Recommend to Council approval of this SCUP with conditions. <br />· Recommend to Council denial of this SCUP. <br />. Recommend tabling this SCUP for further review. <br />
