Second by Councilperson Ebow. The motion carried, 7 <br />ayes, 0 nays. <br /> <br />Ayes: Councilpersons Sutherland, Engelken, Ebow, McLaughlin, Gay, <br />Maxwell and Mayor Malone. <br />Nays: None <br /> <br />8. CONSIDER APPROVAL OR OTHER ACTION REGARDING AN <br />ORDINANCE TO CWSE, VACATE AND ABANDON THE ALLEYS IN <br />BWCKS 276, 295, & 304, TOWN OF LA PORTE; THE EAST "H" <br />STREET AND EAST "I" STREET RIGHTS-OF-WAY BETWEEN SAN <br />JACINTO AND ARIZONA STREETS; AND THE ARIZONA RIGHT-OF- <br />WAY BETWEEN "G" AND PARK STREETS AND RETAINING <br />V ARIOUS UTILITY EASEMENTS(Res. 98-2233) - G. Rankin <br /> <br />City Engineer Doug Kneupper presented summary and recommendation. Mr. <br />Kneupper informed Council that City has been petitioned by La Porte <br />Independent School District to close, vacate, and abandon the alleys in Blocks <br />276, 295 &. 304, Town of La Porte; the East "H" Street and East "I" Street <br />Rightso.of-Way between San Jacinto and Arizona Streets; and the Arizona (5th) <br />Street Right-of-Way between East "G" and Park Streets. The purpose of this <br />request is to facilitate the District's current plan for construction of a new <br />administration facility in Block 304, as well as its future plans for expansion. <br />The Planning and Public Works Departments have reviewed this request and <br />have dl~termined the need to retain various utility easements to facilitate existing <br />City and Harris County Flood Control facilities. Additionally, District <br />abandonment and/or relocation of existing franchised utilities. <br /> <br />In accordance with Article n, Section 62-35 of the Code of Ordinances, the <br />District is exempted from the payment of fair market value to the City for the <br />aforementioned rights-of-way. <br /> <br />Staff r(~ommends closing, vacating, and abandoning the alleys in Blocks 276, <br />295, &. 304, Town of La Porte; the East "H" Street and East "I" Street Rights- <br />of-Way between San Jacinto and Arizona Streets; and the Arizona (5th Street) <br />Right-of-Way between East "G" and Park Streets and providing for various <br />easements to be retained by the City and Harris County Flood Control. <br /> <br />City Alttorney Read: ORDINANCE 98-2233 - AN ORDINANCE VACATING, <br />ABANDONING AND CLOSING THE ALLEYS IN BLOCKS 276, 295 &. 304, <br />TOWN OF LA PORTE; THE EAST "H" STREET RIGHT-OF-WAY <br />BETWEEN SAN JACINTO STREET &.
