<br />Under the Fair Labor Standards Act and amendments of 1985, the City of La <br />Porte has elected to utilize exception 7 (k) and has established a 28-day work <br />cycle for its Firefighters who regularly work 24-hour shifts. The recognized <br />average workweek for these employees is 53 hours. For 24-hour Firefighter shift <br />personnel, the workweek shall begin and end at the start of the first work shift <br />after the first Sunday midnight in the 28-day work cycle. <br /> <br />Calculation of overtime pay for 24-hour Firefighter shift personnel shall be based <br />on the number of hours worked over 212 in a 28-day work cycle. Overtime pay <br />will be calculated and employees compensated for hours worked over 212 at the <br />conclusion of the 28-day cycle or every other payday. <br /> <br />Hours worked is defined for all personnel to mean hours of physical presence at <br />a job site. <br /> <br />When an overtime eligible employee who is on scheduled time off is required to <br />work unscheduled hours during the same work week as the scheduled time off, <br />the scheduled time off will be counted as "hours worked" thereby allowing the <br />employee to be eligible for overtime pay. For purposes of this policy, scheduled <br />time off is: <br />1. Approved holiday leave <br />2. Jury duty <br />3. Military leave <br />4. Vacation <br /> <br />6. Standby Pay <br /> <br />Employees who are required to be on standby duty shall be compensated at a <br />predetermined rate of pay while on standby status. Employees scheduled for <br />standby duty must be able to be at the work site within 1 hour of the call to work. <br /> <br />Employees who work overtime during their assigned standby duty period shall be <br />paid at one and one-half times their regular basic hourly pay rate in accordance <br />with FLSA, as well as the predetermined standby duty pay rate. <br /> <br />Standby pay shall not be paid to any employee: <br /> <br />1. Who is placed on standby due to emergency situations such as hurricanes <br />and floods <br /> <br />2. Who is placed on standby while awaiting court proceedings <br />7. Longevity Pay <br /> <br />Longevity pay is a benefit for length of continuous regular full-time employment <br />with the City.
