<br />VII. NONDISCIPLlNARY TERMINATIONS <br /> <br />1. Voluntary Termination <br /> <br />Employees voluntarily terminate their employment with the City when they: <br /> <br />1. Resign either verbally or in writing <br />2. Fail to report to work without notice to the City for 3 consecutive workdays <br />unless the employee's absence is excused or FMLA protected leave <br /> <br />2. Inability to Perform Job <br /> <br />With the approval of the City Manager, a Department Director may require that a <br />current employee undergo a medical examination, at the City's expense, to <br />determine if such employee is able to perform the essential functions of the <br />employee's current position. <br /> <br />Employees may be separated from City employment because of incapacity for <br />medical reasons, either physical or mental, when the employee is no longer <br />capable of performing the essential job functions of the position. <br /> <br />3. Termination Due to Reorganization, or Economics <br /> <br />The City may need to terminate employees due to reorganization, eliminating <br />jobs, budget constraints, or lack of work. The City will attempt to provide <br />advance notice of such terminations. <br /> <br />Terminations due to reorganization, eliminating jobs, budget constraints, or lack <br />of work are not disciplinary terminations and are not subject to procedures <br />applicable to disciplinary terminations. <br /> <br />Employee Policies Handbook/Page 38 <br />
