<br />RESOLUTION NO. 2008- II <br /> <br />A RESOLUTION PROHIBITING THE ISSUANCE OF BUILDING PERMITS WITHIN <br />AN AREA DESIGNATED FOR RIGHT-OF-WAY ACQUISITION ASSOCIATED WITH <br />HARRIS COUNTY FLOOD CONTROL DISTRICT PROJECT F216-D0-00 PHASE II <br />WATERSHED IMPROVEMENTS; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The Harris County Flood Control District, through an Interlocal <br />cooperation contract with the City of La Porte, has determined the preliminary right-of- <br />way proposed for the F216-00-00 Phase II Watershed Improvements. A map showing <br />the location of this preliminary right-of-way is attached to this resolution as Exhibit "A", <br />incorporated by reference herein, and made a part hereof for all purposes. The Harris <br />County Flood Control District has requested that the City of La Porte issue no building <br />permits for any area within the proposed right-of-way. <br /> <br />Section 2. From and after the effective date of this resolution, no City of La <br />Porte building permits shall be issued in the area of the proposed right-of-way for Harris <br />County Flood Control District Project F216-00-00 Phase II Watershed Improvements, as <br />shown on the map attached hereto as Exhibit "A". <br /> <br />Section 3. The City Council officially finds, determines, recites and declares <br />that a sufficient written notice of the date, hour, place and subject of this meeting of the <br />City Council was posted at a place convenient to the public at the City Hall of the City of <br />La Porte, Texas for the time required by law preceding this meeting, as required by the <br />Open Meetings Law, Article 6253-17, Texas Revised Civil Statutes Annotated; and that <br />this meeting has been open to the public as required by law at all times during which <br />this resolution and the subject matter thereof has been discussed, considered and <br />formally acted upon. The City Council further ratifies, approves and confirms such <br />written notice and the contents and posting thereof. <br />
