9. All inquiries from an attorney or any other contacts from outside of the company, <br />including those from law enforcement agencies or from the employee under <br />investigation, should be referred to Legal. <br />Investigative or other follow up activity will be carried out without regard to the suspected <br />individual's position, level or relationship with the City of La Porte. <br />Questions or Clarifications related to This Policy <br />All questions or other clarifications of this policy and its related responsibilities should be <br />addressed to the Finance Department, who shall be responsible for the administration, revision, <br />interpretation, and application of this policy. <br />3.07 Conflict of Interest <br />Employees shall conduct their affairs and actions so that there will be no conflict of interest with <br />their employment by the City of La Porte. <br />Conflict of Interest shall include, but not be limited to: <br />• Soliciting, accepting, or agreeing to accept a financial benefit, other than from the City <br />that might tend to influence the employee's performance of duties for the City, of that <br />which the employee knows or should know is offered with intent to influence the <br />employee's performance. <br />• Accepting employment or compensation that might reasonably induce the employee to <br />disclose confidential information acquired in the performance of official duties. <br />• Accepting outside employment or compensation that might reasonable tend to impair <br />independence of judgment in performance of the duties for the employee. <br />• Making any personal investment that might reasonably be expected to create a <br />substantial conflict between the employee's private interest and duties for the City. <br />• Soliciting, accepting or agreeing to accept a financial benefit from another person in <br />exchange for having performed duties as a City employee as a favor to that person. <br />3.08 Gifts <br />An employee may not receive any income or other material gain from anyone outside the City <br />for services provided by the employee in the performance of his or her job with the City. <br />Individual City employees are prohibited from soliciting, accepting or agreeing to accept any gift, <br />gratuity, favor, benefit or anything else of value from any person, organization, or other entity <br />who has done business, is doing business, or seeks to do business, with the City. However, an <br />employee who accepts the following will not be in violation of this policy: <br />• an award publicly presented in recognition of public service <br />• tee-shirts, caps and other similar promotional material <br />• any gift which would have been offered or given to the employee even if the employee were <br />not a City employee <br />15 <br />
