3.09 Outside Employment <br />An employee of the City of La Porte is not permitted to engage in outside employment where <br />such employment would bring the City into disrepute, reflect discredit upon the employee as an <br />employee of the City, interfere with the performance of the employee's City duties, present a <br />conflict of interest, result in misuse of City property or funds, or result in the use of the City <br />position for personal gain. <br />Outside employment, which does not constitute a conflict of interest, interfere in the <br />performance of their normal duties may be permitted with the written approval of the City <br />Manager or designee. An employee will not be covered by the City's workers' compensation <br />insurance while working for another employer or while self-employed <br />Approval for outside or self-employment as set out in this policy does not authorize an employee <br />on FMLA leave, sick leave, disability leave, workers' compensation leave, or an unpaid leave of <br />absence, to engage in any outside or self-employment. Under no circumstances may an <br />employee on FMLA leave, sick leave, disability leave, workers' compensation leave, or an <br />unpaid leave of absence, engage in outside or self-employment as defined in this policy. <br />3.10 Political Activity <br />City employees will not be appointed or retained on the basis of their political support or <br />activities. City employees are encouraged to vote and to exercise other prerogatives of <br />citizenship consistent with state and federal law and these policies. City employees may not: <br />• Publicly endorse or campaign in any manner for any person seeking a City public <br />office while on City time. <br />• Use his/her position or office to coerce political support from employees or citizens. <br />• Use his/her official authority or influence to interfere with or affect the result of a <br />campaign issue, an election or nomination for public office. <br />• Use working hours or City property to be in any way concerned with soliciting or <br />receiving any subscription, contribution or political service to circulate petitions or <br />campaign literature on behalf of an election issue or candidate for public office in any <br />jurisdiction. <br />• Hold an appointive or elective office of public trust where service would constitute a <br />direct conflict of interest with City employment. Upon becoming a candidate or <br />otherwise deciding to seek or assume such an office, an employee must immediately <br />resign or will be dismissed upon failure to do so. <br />3.11 Solicitation <br />Active solicitation for sale of items or donations and distribution of literature of any kind for any <br />purpose without the City Manager's approval is prohibited by the public or City employees on <br />City property during working hours. <br />16 <br />
