<br />ORDINANCE NO. 2009- ~/3~ <br /> <br />AN ORDINANCE GRANTING A PERMIT UNDER ORDINANCE NO. 2004-2755, <br />BEING CHAPTER 102, NATURAL RESOURCES, ARTICLE IV, "PIPELINE <br />TRANSPORTATION" OF THE CODE OF ORDINANCES OF THE CITY OF LA <br />PORTE, TEXAS, TO CONSTRlJCT A TWELVE INCH (12") PIPELINE FOR THE <br />TRANSPORTATION OF DRY GAS AND CRUDE OIL BY-PRODUCTS; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEIU<:OF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte has received an application from <br />Shell ChemicaL L.P. requesting a permit under Ordinance No. 2004-2755, being Chapter 102, <br />Natural Resources, Article IV, "Pipeline Transportation" of the Code of Ordinances of The City <br />of La Porte, to construct and operate a l2-inch (12") pipeline for the transportation of DRY GAS <br />AND CRUDE OIL BY -PRODUCTS, crossing the City of La P0l1e, as shown on Exhibit "A" of <br />attached hereto and made part of herein. The application of Shell Chemical, L.P. has been <br />reviewed by the Director of Planning, who has found that said application meets all requirements <br />of Ordinance 2004-2755, and has recommended its approval. <br /> <br />Section 2. The City Council of the City of La Porte hereby approves the application <br />of Shell Chemical, L.P., and this Ordinance authorizes the Director of Planning or his designee <br />to execute the permit as requested by applicant. <br /> <br />Section 3. <br /> <br />The City Council officially finds, determines, recites, and declares that a <br /> <br />sutlicient written notice of the date, hour, place, and subject of this meeting of the City Council <br />was posted at a place convenient to the public at the City Hall of the City for the time required by <br />law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas <br />Government Code~ and that this meeting has been open to the public as required by law at all <br />times during \vhich this ordi nance and the subject matter thereof has been discussed, considered, <br />and formally acted upon. The City Council further ratifies, approves and confirms such written <br />notice and the contents and posting thereof. <br /> <br />EXHIBIT I <br />
