• <br />Commission to require pedestrian sidewalks when it feels their inclusion will serve the <br />public interest. Staff would recommend the inclusion of sidewalks within the Pecan Crossing <br />Subdivision. Responsibility for construction of the walks should be specified by covenant. <br />Development Ordinance, Section 4.03.B requires that "following review of the Preliminary <br />Plat, the Commission shall ...take one of the following actions." <br />1. Approve the Preliminary Plat as filed; <br />2. Conditionall~+ approve the Preliminary Plat as filed, provided, the reasons are <br />stated in writing and a copy of the statement is signed by the Chairman of the <br />Planning Commission. <br />3. Disapprove the Preliminary Plat as filed, provided, the reasons for such <br />disapproval are stated in writing and a copy of the statement is signed by the <br />Chairman of the Planning Commission. <br />As noted, the revised Preliminary Plat substantially complies with applicable ordinance <br />requirements. Staff therefore, recommends that the revised Pecan Crossing, Section I <br />Preliminary Plat be conditionally approved subject to the considerations noted above. <br />Under the terms of the Development Ordinance, a conditional Preliminary Plat approval <br />authorizes the developer to proceed as follows: <br />• Submit Final Plat and Covenants. <br />• Make payment to the City in lieu of parkland dedication. (Based on a total <br />of 65 residential lots assessed at $175 per lot, the total payment for Section <br />I will equal $11,375.) <br />• Submit subdivision construction drawings. (Already submitted.) <br />Staff will review the Final Plat, Covenants, and construction drawings. This is also the point <br />in the review process when staff will ensure that issues such as easement dedication, street <br />lighting, and flood control approvals have been finalized. Following this review and <br />resolution of any outstanding issues, the Final Plat may be approved by the Commission. <br />At this point, the developer will be given a development authorization to begin construction <br />of public improvements. As an alternate, the developer may, at his option choose to post <br />a bond to cover the cost of infrastructure construction. If a bond is posted, the Final Plat <br />may be recorded prior to public improvement construction; otherwise following completion <br />of construction and City acceptance of public improvements, the Final Plat will be released <br />for filing with Harris County Department of Deed Records. <br />
