This figure is based on a $175.00 per dwelling unit basis. <br />The money will be placed in an escrow account and will only be used for <br />the acquisition or improvements of public park land or facilities located <br />in Park Zone 1, the zone in which Summer Winds is located. <br />• Subdivision covenantsldeed restrictions for Section II are provided to the <br />City for review and approval. <br />• Subdivision construction plans are provided for review and approval by <br />the City. <br />• Title Certificate is provided for review by the City. <br />Conclusion: Development Ordinance, Section 4.03.B requires that "following review <br />of the Preliminary Plat, the commission shall ... Take one of the following <br />actions." <br />1. Approve the Preliminary Plat as filed; <br />2. Conditionally Approve the Preliminary Plat as filed, provided, the <br />reasons are stated in writing and a copy of the statement is signed <br />by the Chairman of the Planning Commission. <br />Disapprove the Preliminary Plat as filed, provided, the reasons for <br />such disapproval are stated in writing and a copy of the statement <br />is signed by the Chairman of the Planning Commission. <br />Using Appendix D of Development Ordinance No. 1444, staff has reviewed <br />the preliminary plat and finds it complies with applicable ordinance <br />requirements. The completed checklist is attached and follows this report. <br />Staff therefore, recommends Approval of the Summer Winds, Section II <br />Preliminary Plat. <br />If the Planning and Zoning Commission approves the Preliminary Plat we <br />recommend the motion include the following: <br />• Confirmation by the Planning and Zoning Commission that sidewalks <br />are required in Summer Winds, Section II. <br />• The Planning and Zoning Commission requests that staff notify the <br />developer of the items referenced in this report that need to be addressed <br />prior to or with the submittal of the final plat. <br />
