be designated as a state archeological landmark." We therefore invite you to submit such information. Similar
information has also been solicited from the applicant. You should consider the fiscal impact of the designation
with an understanding of the how the Texas Antiquities Code applies to buildings and structures. Title 13, Part 11,
Chapter 26.22 of the Texas Administrative Code (Application for Historic Structure Permits) describes the permit
process for buildings and structures that are designated State Archeological Landmarks. This section of the code
outlines the steps that the owner of the Sylvan Beach Pavilion would have to take before any work could be
performed that has the potential to cause removal, damage, or alteration to the integrity, form, or appearance of the
materials, features, or landform of the historic structure and its site. This section also identifies the standards for the
treatment of historic properties that must be adhered to under the code.
We understand your concerns regarding the limited timeline for use of Hurricane Ike grant funds and are committed
to working with your staff to ensure a successful project. We look forward to maintaining a partnership that will
foster effective historic preservation. If you have any questions or if we can he of further assistance, please contact
Greg Smith with History Programs Division at 512/463 -6013 or Kelly Little with the Division of Architecture at
512/463 -7687.
Sincerely,
Mark Wolfe, Executive Direct
Cc: Commissioner Jack Mormon, Harris County
John R. Blount, PE, LEED AP, Harris County
Mike Swain, AIA, Harris County
Janet Wagner, Chair, Harris County Historical Commission
