<br />RESTRICTIONS
<br />

<br />Section 1: Land Use. All lots shall be used fo;- single family
<br />residence purposes only. The teI;m' "residence purposes" as used herein shall
<br />be held and construed to exclude hospitals, duplex houses and apartment
<br />houses, and to . exclude conunercial and professional uses; and to exclude any
<br />development operations or drilling for oil, gas or other minerals, or any
<br />refining or quarrying, or mining, or 'the placing or maintaining' on the
<br />premises of any tanks, wells, shafts, mineral excavation derricks or
<br />structures of any kind incident to any such oil, gas or other mineral .
<br />operations; and any such usage of this property is hereby expressly prohi.-
<br />bi ted.
<br />
<br />Section 2: Architectural Control. No building shall be erected,
<br />placed or'altered on any ;Lot until the construction plans and specifications
<br />and a plot plan showing the location of the structure shall be approved by
<br />the Architectural . Control Commi. ttee, . herefn~ter established, as to quality
<br />of workmanship and materials, hannony of extemal design wi 1:h existing
<br />structures, and as to location with respect to topography and finished grade'
<br />elevation.

<br />. Section 3: One Residence Only. Only one residence shall be
<br />constructed on each lot; however, this shall not prohibit the construction
<br />of a residence on a portion of two or more lots as shown by the Subdivision
<br />Plat, provided such tract constitutes a home site as' defined in the
<br />succeeding section.
<br />
<br />Section 4: Designation of Ad;oining Lots as Homesites. Parts of
<br />two or more adjoining lots facing the same street in the same block may',.be
<br />designated as one homesite provided the lot frontage shall not be less than
<br />the minimum frontage of lots in the same block facing the same street.
<br />
<br />Section 5: New Construction. No structure of any kind shall be
<br />moved onto any lot (except as provided in Section 11 hereof), it being the
<br />intention that only new construction shall be placed and erected thereon.
<br />
<br />Sec~ion 6: Definition with Respect to Building Lines. The word
<br />"house" or "residence" as used herein with reference to building lines'
<br />shall include covered carports, patio covers, galleries, covered porches,
<br />porte cocheres, steps, projections and every other pennanent part of the
<br />improvements, except roofs. .
<br />
<br />Section 7: Prohibition as Living Quarters. No garage or out-
<br />building on any lot shall be used as a residenpe or living' quarters.
<br />
<br />Section,,8: Hannonv of Garages and Outbuildings. No garage or
<br />outbuildings shall be erected on any lot, with roof or outside walls of
<br />materials or color different from those used in the house or residence
<br />erected on such lot, except with the written consent of the Architectural '
<br />Control Commi. ttee.
<br />
<br />. Section 9: Dumping. No trash, garbage, ashes, refuse or other
<br />waste shall be thrown or dumped on any vacant lot.
<br />
<br />Section 10: Animals. No horses, cattle, hogs, livestock, or
<br />other animals, or rabbits, or poultry, of any kind, shall be raised, bred,
<br />kept, staked or pastured on any lot, except that dogs, cats or other.
<br />household pets may be kept, provided they are not kept, bred or maintained
<br />for any commercial purpose.
<br />
<br />Section 11: Building Materials: Temporary Buildings. No
<br />building material of any kind or character shall be placed or stored upon
<br />any lot until the Owner is ready to commence improvement and then such material
<br />shall be placed only within the property lines of the lot, and shall not
<br />be placed in the streets or between the curb and property line. No
<br />structure or temporary building. of any kind or character, with the exception
<br />of lawn storage buildings and children I s playhouses, may be placed upon any
<br />lot; provided, however, that Declarant rese~es the exclusive right to erect,
<br />place and maintain such facilities in or upon any portion of the Properties
<br />as in its sole descretion may be necessary or convenient while selling lots,
<br />selling or constructing residences and constructing other improvements upon
<br />the Properties. Such facilities may include but shall not be limited to,
<br />sales and construction offices, storage areas, model units, signs and portable
<br />toilet facilities.
