<br />Section 29: Protective Screening. Protective screening areas are
<br />established as shown on the recorded plat. Except as otherwise provided
<br />herein regarding street intersect~o~s under "Sight Distance at Intersections",
<br />planting, fences or walls shall be maintained throughout the entire length
<br />of such areas by the Owner or Owners of the lots at their own expense to
<br />fom an effective screen for the protection of the residential area. No
<br />building or stmcture except a screeri fence or wall or utilities or drainage
<br />facilities shall be placed or permitted to remain in sueh areas. No
<br />vehicular access over the area shall be penni tted' except for the purpose '
<br />of installation and ~intenance of screening, utilities and drainage
<br />facilities.

<br />RESERVATIONS. EXCEPTIONS AND DEDICATION

<br />Section 1: Recorded Subdivision Plat of the Properties. The
<br />Subdivision Plat dedicat~s for use as such, subject to the limitation as set'
<br />forth therein, the streets and easements shown thereon and such Subdivision
<br />Plat :further establishes certain .restrictions applicable to the Properties,
<br />including, without limiation,' certain minimum setback lines. All dedica-
<br />tions, limitations, restrictions and reservations shown on the Subdivision
<br />Plat are incorporated herein, and shall be construed as being adopted in
<br />each and every contract, deed or conveyance executed or to be executed by or
<br />on behalf of Declarant, conveying said proper~ or any part thereof,
<br />whether specifical,ly referred to therein or not.
<br />
<br />Section 2: Easements. Declarant reserves the easements and rights
<br />of way as shown on the Subdivision Plat for the purpose of const.ructing,
<br />mairitaining and repairing ~ system or sYstems of electric lighting, elec-
<br />trical power, telegraph an,d telephone line or lines, gas, sewers, cable
<br />television or any other utility Declarant sees fit to install in, across
<br />or under the Properties. Declarant reserves' the right to make changes in
<br />and additions to the above easements for the purpose of most efficiently
<br />and economically installing the improvements. Neither Declarant nor any
<br />utility company or authorized political subdivision using the easements
<br />herein referred to., shall be liable for any damages done by them or their
<br />assigns, their agents, employees or servants, to fences, shrubbery, trees
<br />or flowers or any other proper:ty. of the OWner on the land covered by said
<br />easements. All easements, as filed of record, are reserved for the mutual
<br />use and accommodation of garbage collectors and all utility companies
<br />desiring to use same. Any utility company shall have the right to remove
<br />and keep all or part of any buildings, fences, trees, shmbs, or other
<br />improvements or growths which in ay way endager or interfere with the
<br />constmction, maintenance, or efficiency of its respective utility system
<br />on any easement strips, and any utility company shall, at all times,
<br />have the right of egress and ingress to and from and upon .said easement
<br />strips for the purpose of constructing, reconstmcting, inspecting,
<br />patrolling, maintaining, and adding to or removing all or any part of
<br />its rE!spective utili ~ system without the necessity at any time of pro-
<br />curing the pennission of anyone.

<br />Section 3: Extension of Connection Privileges to Systems.
<br />Declal~ant reserves the right to grant or deny to areas outside of the
<br />Subdivision connection priYf,leges to any sewerage or water systems in-
<br />stalled at the cost of De~larant.

<br />Section 4: Modification of Easements. Declarant reserves the
<br />right to make minor changes in and additions to the easements shown on
<br />the Subdivision Plat for t,he purpose of more efficiently and economically
<br />installing the utili~ systems;

<br />Section 5: Installation of Paving. . Declarant reserves the right,
<br />during installation of paving of the streets as shown on the Subdivision'
<br />Plat, to enter onto any. of the Properties fu r the purpose of disposing of .
<br />street excavation, including the removal of any trees,. if necessary,
<br />whether or not the Properties have been conveyed to or contracted for
<br />sale to any other Owner.
