This conveyance is made and accepted subject to all applicable zoning laws,
<br /> regulations, and ordinances of municipal and /or governmental authorities and is further made
<br /> subject to all restrictions, covenants, conditions, agreements, assessments, maintenance
<br /> charges, easements, previously conveyed or reserved mineral and royalty interests, and other
<br /> title matters, but only to the extent they are in effect and shown of record in the hereinabove
<br /> mentioned County and State, and applicable to a municipal corporation of the State of Texas.
<br /> This conveyance is further subject to the reservation by the District of the free,
<br /> uninterrupted, unobstructed, and perpetual use of and separate right to maintain, as the District
<br /> deems necessary, a drainage easement ten (10) feet in width along the northern portion of Lot
<br /> Fifteen (15) in Block One Thousand One Hundred Thirty (1130), for the purpose of flood control,
<br /> drainage, and such other purposes and objects as Grantee shall lawfully be authorized to
<br /> engage in or perform.
<br /> TO HAVE AND TO HOLD the District Tract, together with all and singular the rights and
<br /> appurtenances thereto in anywise belonging unto the City, its successors and assigns, forever;
<br /> and the District does hereby bind itself, its successors and assigns, to WARRANT and
<br /> FOREVER DEFEND, all and singular the said property unto the City, its successors and
<br /> assigns, against every person whomsoever lawfully claiming, or to claim the same, or any part
<br /> thereof, by, through, or under the District but not otherwise.
<br /> N 3. The conveyances evidenced hereby are made and accepted by the City and the
<br /> 1 District with the express stipulation that no liens, express or implied, shall arise by virtue of the
<br /> 0 exchange of properties affected by and between the City and the District as evidenced hereby,
