<br />7" <br /> <br />.. <br /> <br />e <br /> <br />e <br /> <br />-2- <br /> <br />such settlement and compromise and constitutes the same to be the <br />judgment of the Court herein. <br />The Court finds that the Defendant, City of La Porte, by. <br />.agreeing to such settlement and compromise, is not admitting or <br />confessing the allegations, conclusions or inferences contained in <br />any pleadings that Plaintiffs have filed in this cause and expressly <br />deny such allegations, conclusions' or inferences 1 and it is <br />expressly understood ~nd ag.reed by the parties hereto and approved <br />and adjudged by the Court that neither the agreement between the <br />parties hereto nor the judgmen~ in this cause shall constitute an <br />admission or any form of estoppel against the Plaintiffs, nor <br />agains,t the Defendant, its officers, agents, and employees, in any <br />future or pending proceedings, whether growing out of the trans- <br />actions made the basis of this suit or otherwise. <br />It is, there~ore, ORDERED, ADJUDGED, and DECREED by the Court <br />that the Defendant,' City of La Porte, and its officers, agents, <br />and employees, are permanently enjoined trom entering upon the West <br />135 feet of Elizabeth Lane, and from otherwise interfering with <br />Plaintiffs' rights to quiet use and enjoyment of sai~ premises. <br />Provided, however, Defendan~, its officers, agents and <br />employees, shall have the right to enter upon the West 135 feet. of . <br />Elizab~th Lane, in its various municipal and governmental <br />capacities, to provide normal and customary municipal services, such <br />as fire, police, ambulance, water, s~wer, garbage collection, and <br />the like, to the properties on the north and south side of the West <br />135 feet of Elizabeth Lane. <br />
