<br />ADDENDUM TO SETTLEMENT AGREEMENT <br /> <br />This document shall serve as an addendum to that Settlement Agreement (the <br /> <br />"Agreement") made and entered into as of 2nd day of November, 2005, by and between: <br /> <br />(i) the City of La Porte, Texas, ("La Porte"), a municipal corporation, (approved as to <br /> <br /> <br />form by its counsel) on the one hand; and, (ii) the Cynthia L. Colvin Revocable Living <br /> <br /> <br />Trust, A Texas Trust ("Colvin") (approved as to form by its counsel) on the other hand. <br /> <br /> <br />La Porte and Colvin may be referred to herein individually as a "Party" and, collectively, <br /> <br />as the "Parties". <br /> <br />Recitals <br /> <br />A. A lawsuit (Cause No. 818839) between the parties in the Harris County <br /> <br />Civil Court at Law No.1, Harris County, Texas (the "Lawsuit") was resolved by agreed <br /> <br />judgment in 2006. <br />B. Prior t6 the agreed judgment, the Agreement .was reached between the <br /> <br />attorneys for La Porte and Colvin as a result of formal mediation, on November 2,2005. <br /> <br />C. Under the terms of the proposed Agreement, the City of La Porte, among <br /> <br />other things, agreed to the closing of portions of E and F streets, including the <br /> <br />intersections ofE and F streets with 13th Street. However, before the Agreement was sent <br /> <br />to the La Porte City Council for ratification, legal counsel for La Porte and Colvin <br /> <br />discussed and negotiated changes regarding the portions of E and F streets to be closed, <br /> <br />necessitated by requirements of City to maintain access to nearby tracts. <br /> <br />--1-- <br />
